Justice KURIAN JOSEPH\n\n Dated :28\/02\/2007\n\n O R D E R\n                               KURIAN JOSEPH, J.\n\n                  ----------------------------------------------\n\n                        W.P.(C) No.5470 of 2004\n\n                  ----------------------------------------------\n\n                      Dated 28th   February,  2007.\n\n\n                                  J U D G M E N T\n<\/pre>\n<p>             The   writ   petition   is   filed   mainly   with   the   following<\/p>\n<p>prayer :-\n<\/p>\n<blockquote><p>             &#8220;To issue a writ of mandamus or other appropriate writ, direction<\/p>\n<p>             or order commanding the respondents 2 to 4 not to proceed with<\/p>\n<p>             Ext.P8 proceedings A5-8146\/01 dated 5.2.2004 issued by the 2nd<\/p>\n<p>             respondent under the Land Conservancy Act holding that there is<\/p>\n<p>             no &#8216;puramboke&#8217; land encroached by the petitioner in property in<\/p>\n<p>             Sy.No.442\/12 of Veeranakavu village and the entire proceedings<\/p>\n<p>             initiated   by   the   2nd  respondent   is   highly   illegal,   arbitrary   and<\/p>\n<p>             violating principles of natural justice and fair play.&#8221;<\/p>\n<\/blockquote>\n<p>On 13.2.2004, this Court passed the following order :-\n<\/p>\n<blockquote><p>             &#8220;Notice is ordered on condition that petitioner will  withdraw the<\/p>\n<p>             suit   and   file   memo   in   Court.
