After following<br \/>\nnecessary procedure, the respondent was dismissed from service vide<br \/>\norder dated 20.06.1996. Two appeals preferred before the competent<br \/>\nauthorities of the petitioner-Corporation by the respondent against<br \/>\nthe said order of dismissal came to be rejected. Therefore, the<br \/>\nrespondent raised a dispute, which, ultimately, culminated into a<br \/>\nreference before the Court below. The Court below, after considering<br \/>\nthe evidence on record, partly allowed the reference as aforesaid, by<br \/>\nway of the impugned award. Hence, this petition.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. The default card of the respondent shows that he had<br \/>\ncommitted eight defaults in the past. It is true that in the criminal<br \/>\ncase filed by the petitioner-Corporation, in connection with the<br \/>\nalleged offence in question, the respondent came to be acquitted.<br \/>\nHowever, the standard of proof in a criminal case is much higher than<br \/>\nwhat is needed in a departmental inquiry. In a criminal case, the<br \/>\nprosecution has to prove the guilt of the accused beyond doubt but,<br \/>\nthe same is not the case in the departmental proceedings. In this<br \/>\ncase, in the departmental inquiry proceedings, the charges levelled<br \/>\nagainst the respondent have proved. Undoubtedly, the act of the<br \/>\nrespondent is serious, particularly, in a dry State like ours.<br \/>\nHowever, looking to the past record of the respondent and the facts<br \/>\nof the present case, the penalty of dismissal from service imposed by<br \/>\nthe petitioner appears to be very harsh and disproportionate.\n<\/p>\n<p>4.\tWhile<br \/>\ngranting reinstatement with continuity in service to the respondent,<br \/>\nthe Court below ought to have imposed some penalty on the respondent.<br \/>\nIn my opinion, if the respondent is imposed the penalty of stoppage<br \/>\nof two increments with future effect, the same would meet with the<br \/>\nends of justice.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the petition is partly allowed. The impugned<br \/>\naward of the Court below directing the petitioner to reinstate the<br \/>\nrespondent on his original post with continuity of service but,<br \/>\nwithout any back wages is confirmed. However, the respondent is<br \/>\nimposed a penalty of stoppage of two increments with future effect.<br \/>\nIt is, however, observed that if in the future the respondent is<br \/>\nfound guilty of a similar kind of offence, then the<br \/>\npetitioner-Corporation shall be at liberty to take necessary<br \/>\nappropriate action against him, without showing any mis-placed<br \/>\nsympathy on such person since the award of the Court below qua<br \/>\nreinstatement in service is confirmed on the assurance given by the<br \/>\nlearned counsel for the respondent that he will not indulge in such<br \/>\nkind of activities in the future. The petition stands disposed of<br \/>\naccordingly. Rule is made absolute to the above extent with no order<br \/>\nas to costs.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
