Said  Rameshchandra Popatlal<br \/>\nTrivedi had never objected regarding the calculation of the disputed<br \/>\nland.  The present petitioners have purchased the said land in the<br \/>\nyear 1998 and till date of filing of the petition they have also not<br \/>\nraised any objection.\n<\/p>\n<p>3.\tIt<br \/>\nis pertinent to note that  Rameshchandra Popatlal Trivedi  &#8211; original<br \/>\nowner has not challenged the order of issuing sanad before the<br \/>\ncompetent authority which was issued in the year 1971. Thereafter on<br \/>\nmaking representation, the Collector has conveyed to the present<br \/>\npetitioners that alternative remedy is available to the petitioners<br \/>\nto file appeal against the order passed by competent authority.  It<br \/>\nis submitted by learned advocate for the petitioners that as no order<br \/>\nis passed by the competent authority,  the petitioners cannot prefer<br \/>\nany appeal before the competent court. It is very difficult to agree<br \/>\nwith the  submission made by  the learned advocate for the<br \/>\npetitioners, but it is an admitted fact that the sanad was issued in<br \/>\nthe name of  Rameshchandra Popatlal Trivedi in pursuance of the order<br \/>\npassed by the competent court. In view of the same, I do not find any<br \/>\nsubstance in the petition.
