Sultan\n     All resident of village - Bedaul Ashli, P.S. - Aurai, District - Muzaffarpur.\n                                                                  --------- Petitioner.\n                                      Versus\nTHE STATE OF BIHAR                                              ---- Opposite Party.\n                                     -----------\n<\/pre>\n<p>02.    20.04.2011                 Heard learned counsel for the petitioners<\/p>\n<p>                        and learned Additional Public Prosecutor for the State.<\/p>\n<p>                                  This application has been filed on behalf of<\/p>\n<p>                        the petitioners for setting aside the order dated<\/p>\n<p>                        18.09.2010 passed in Criminal Revision No. 131\/2010<\/p>\n<p>                        by District and Sessions Judge, Muzaffarpur, learned<\/p>\n<p>                        judge allowed the petition of opposite party no.2<\/p>\n<p>                        wherein he challenged the order dated 26.05.2010<\/p>\n<p>                        passed by Smt. Anindita Singh J.M. 1st Class,<\/p>\n<p>                        Muzaffarur, who dismissed the Complaint petition<\/p>\n<p>                        under Section 203 of the Code of Criminal Procedure<\/p>\n<p>                        as well as setting aside the order dated 10.12.2010<\/p>\n<p>                        passed in Complaint Case No. 3615\/2009 taking<\/p>\n<p>                        cognizance for the offence under section 304(B), 201,<\/p>\n<p>                        504, 323 and 34 of the Indian Penal Code.<\/p>\n<p>                                  Earlier Complaint Case was dismissed under<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>          section 203 of the Code of Criminal Procedure vide<\/p>\n<p>          order dated 26.05.2010 but Criminal Revision No.<\/p>\n<p>          131\/2010 was preferred before the learned Sessions<\/p>\n<p>          Judge, Muzaffarpur vide order dated 18.09.2010<\/p>\n<p>          allowed   the   Revision    petition   basing   whereof<\/p>\n<p>          cognizance was taken.\n<\/p>\n<p>                    After some argument, learned counsel for<\/p>\n<p>          the petitioners seeks permission to withdraw this<\/p>\n<p>          application with a liberty to agitate all his points<\/p>\n<p>          before the trial court at appropriate stage preferably at<\/p>\n<p>          the time of hearing on the point of charge.<\/p>\n<p>                    With the above liberty, this application<\/p>\n<p>          stands disposed of as withdrawn.\n<\/p>\n<\/p>\n<pre>Rajeev\/                              ( Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.
