Rajendra Babu &amp; Doraiswamy Raju\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>J  U  D\t G  M  E  N  T<br \/>\nRAJENDRA BABU,\tJ.  :\n<\/p>\n<p>\tA fire broke out at Uphaar theatre on the evening of June 30, 1997<br \/>\nin consequence of which a number of persons were either killed or<br \/>\ninjured.   An Association was formed of victims of Uphaar tragedy.  They<br \/>\nfiled a writ petition on the ground that the public authorities failed to<br \/>\ndischarge their statutory obligations and the standard of safeguards set<br \/>\nout under the statute and the rules framed thereunder for the purpose of<br \/>\npreventing a hazards of breaking out of fire was not observed.\t The<br \/>\nlicense and permits to the theatre were issued contrary to the mandatory<br \/>\nprovisions of the statute and rules.  The petitioners thereafter sought for<br \/>\nadequate compensation to the victims in the said tragedy from the<br \/>\nrespondents for failure to observe the statutory obligations and also on<br \/>\nthe basis of the fundamental rights guaranteed under the Constitution.\n<\/p>\n<p>\tThe respondents in the writ petition, who are petitioners before us,<br \/>\nraised a preliminary objection that the writ petition is not maintainable<br \/>\non various grounds that the extraordinary remedy of a writ petition<br \/>\ncannot be used in case of a break out of fire in a theatre which is the<br \/>\nresult of complex series of causative factors for claiming and awarding<br \/>\ndamages to hundreds of persons as against the statutory authorities and<br \/>\nthe company owning the theatre.\t  It was also detailed that the precise<br \/>\ncause of the incident, the role of each of the individual parties and the<br \/>\nextent of their blameworthiness, the manner in which the liability has to<br \/>\nbe apportioned and as to who are entitled to claim the damages and what<br \/>\nis the extent of that amount ought to be awarded to each one of them<br \/>\nand such questions relate to causation, the extent of culpability, people<br \/>\nentitled to claim damages and the amount due to them and all such<br \/>\nquestions involve complex investigation based on evidence.   Therefore,<br \/>\nthe writ petition was not an appropriate remedy and could not be<br \/>\nmaintained.\n<\/p>\n<p>\tA Division Bench of the High Court considered the various<br \/>\ncontentions raised in the course of the arguments and wrote an order<br \/>\nrunning to nearly 100 pages and ultimately held that at the preliminary<br \/>\nstage the question of maintenance of the petition was being considered<br \/>\nand, therefore, it is not deciding the case of merits.\tThe facts referred to<br \/>\nin the course of the order are as stated by the parties and not as found<br \/>\nby way of a decision on merits.\t The observations and the reference to<br \/>\nfacts in the course of the order were only of preliminary character.  The<br \/>\nHigh Court held that all the court could say is that it could not be<br \/>\nconcluded that the petition could not be maintained.\n<\/p>\n<p>\tThe learned counsel for the petitioners before us raised an<br \/>\napprehension that the court might adopt some procedure of appointing a<br \/>\nCommission to gather certain facts which, by itself, may not be sufficient<br \/>\nto dispose of the matter and that  the Commission appointed would only<br \/>\nto report whether the rules and regulations were complied therewith or<br \/>\nnot and no more.\n<\/p>\n<p>\tWhatever be the apprehensions of the learned counsel they could<br \/>\nvery well be pointed out to the learned Judges of the High Court who<br \/>\nwould hear the matter ultimately before the High Court and address their<br \/>\narguments as to the manner in which a dispute of this nature could be<br \/>\nresolved satisfactorily. We are sure that when such arguments are<br \/>\naddressed before the High Court,  they will be appropriately considered<br \/>\nand therefore,\tthere is absolutely no basis for any apprehension of this<br \/>\nnature as entertained by the learned counsel for the petitioners.\n<\/p>\n<p>\tConsidering the nature of the order passed by the High Court and<br \/>\nthe arguments addressed before us, we do not think, there is any<br \/>\njustification for us to interfere with the order made by the High Court.\n<\/p>\n<p>\tThis petition stands rejected.\n<\/p>\n<p>\t\t\t\t\t\t.J.\n<\/p>\n<p>\t\t\t\t\t\t[ S.
