The Second Appeal has<br \/>\nbeen sought to be preferred posing the substantial questions of law<br \/>\nas follow:\n<\/p>\n<p>(1)\tWhether<br \/>\nthe judgment, order and decree passed by the learned Appellate Court<br \/>\nquashing and setting aside the judgment and order dated 31.08.2007<br \/>\npassed by the learned Principal Senior Civil Judge, Amreli in Special<br \/>\nCivil Suit No. 1 of 2002 and remanding the matter back by framing an<br \/>\nissue as to whether defendant has proved the will dated 27.12.1971<br \/>\nand to what effect is correct?\n<\/p>\n<p>(2)\tWhether<br \/>\nthe judgment and order of remand is sustainable in view of the<br \/>\nplaintiffs have miserably failed to prove their case?\n<\/p>\n<p>(3)\tWhether<br \/>\nthe judgment and order of remand the case to the trial Court is bad<br \/>\nin law in view of the facts that the suit filed by the plaintiffs was<br \/>\nbarred by law of limitation.\n<\/p>\n<p>(4)\tWhether<br \/>\njudgment and order passed by the learned Appellate Court for remand<br \/>\nthe matter and directing the defendant to prove the will is contrary<br \/>\nto the law itself?\n<\/p>\n<p>3.\tThus,<br \/>\nthe Second Appeal has been preferred challenging the impugned order<br \/>\npassed by the lower Appellate Court remanding the matter back to the<br \/>\ntrial Court for deciding afresh with regard to a particular issue<br \/>\nregarding the will. There is a delay in filing the Second Appeal and<br \/>\ntherefore the aforesaid Civil Application No. 14795 of 2010 has been<br \/>\npreferred for condonation of delay of 383 days on the grounds set out<br \/>\nin this application.\n<\/p>\n<p>4.\tHaving<br \/>\nheard the learned counsel, the explanations offered do not justify<br \/>\nthe condonation of delay. Though, normally, the delay is condoned<br \/>\nwith liberal approach. However, considering the facts and<br \/>\ncircumstances with regard to the grounds mentioned for justifying the<br \/>\ndelay cannot be said to be sufficient and as there is no sufficient<br \/>\ncause made out for condonation of delay, present Civil Application<br \/>\ndeserves to be rejected. Hence, the application stands rejected.\n<\/p>\n<p>5.\tIn<br \/>\nview of the order passed in Civil Application for condonation of<br \/>\ndelay refusing to condone the delay, Second Appeal Stamp No.159 of<br \/>\n2010 as well as Civil Application Stamp No.<br \/>\n8751 of 2010 for<br \/>\nstay do not survive and shall stand dismissed<br \/>\naccordingly.
