He has<br \/>\nbrought to the notice of this Court a judgment delivered by a<br \/>\nDivision Bench of this Court in 2004(1) G.L.H. 246, in<br \/>\nthe case of National Insurance Company Limited<br \/>\nVs. Mukeshbhai Bhalchandrabhai Jani, to contend that the<br \/>\npetitioner has a right to exercise an option to choose either of the<br \/>\nproceedings under sections 163A and 166 of the Motor Vehicles Act,<br \/>\nand the said option can be exercised at any stage of the proceedings,<br \/>\nincluding at the appellate stage.\n<\/p>\n<p>\tNotice,<br \/>\nreturnable on 26.07.2011.\n<\/p>\n<p>\tIt<br \/>\nshall be open to the learned advocate for the petitioners to move an<br \/>\napplication for adjournment of the proceedings before the Tribunal on<br \/>\nthe next date.\n<\/p>\n<p>(Smt.
