SINGH, JUDGE<br \/>\nDate : 20\/11\/2008<br \/>\n:Judgment :\n<\/p>\n<p>_______________________________________________________<br \/>\nPetitioner had applied seeking consideration for<br \/>\nselection to the post of Lecturer Grade-I (Computer<br \/>\nScience) in the Department of Technical Education<br \/>\npursuant to Jammu and Kashmir Public Service<br \/>\nCommission, Srinagar&#8217;s Notification No. 4-PSC of 2001<br \/>\ndated 18.5.2001.\n<\/p>\n<p>Falling in the list of short-listed candidates, he was<br \/>\ninterviewed by the Jammu and Kashmir Public Service<br \/>\nCommission on 22.01.2004.\n<\/p>\n<p>The Commission thereafter issued a select list of<br \/>\ncandidates who had applied for the post of Lecturer<br \/>\nGrade-I (Computer Science) under Open merit category<br \/>\nand RBA category but no select list was issued for the<br \/>\npost reserved for Scheduled Caste Category candidates.<br \/>\nProjecting that being the only Scheduled Caste<br \/>\ncandidate who had been short-listed to seek consideration<br \/>\nof the Commission for selection against the reserved<br \/>\npost of Lecturer Grade-I (Computer Science), the<br \/>\npetitioner was required to be reflected in the select list<br \/>\nwhich the respondents were under an obligation to<br \/>\npublish for facilitating the appointment of the petitioner<br \/>\nagainst the post of Lecturer Grade-I (Computer Science),<br \/>\nthe petitioner, aggrieved by the omission of the<br \/>\nrespondents to publish the select list, has filed this writ<br \/>\npetition seeking issuance of a command to the<br \/>\nCommission to issue the select list for the post of<br \/>\nLecturer Grade-I in Computer Science under the reserved<br \/>\ncategory of Scheduled Caste and to the State to appoint<br \/>\nhim as Lecturer Grade-I in Computer Science against the<br \/>\npost reserved for Scheduled Caste category.<br \/>\nIt is indicated by the Commission through its<br \/>\nobjections that on assessment of overall performance of<br \/>\nthe petitioner, he was not found to fall even within the<br \/>\nrelaxed standard prescribed for candidates belonging to<br \/>\nthe Scheduled Caste Category and having failed to make<br \/>\nthe grade, the petitioner was not required to be reflected<br \/>\nin the select list. Denying the petitioner&#8217;s entitlement to<br \/>\nselection and appointment against the post of Lecturer<br \/>\nGrade-I (Computer Science), the Commission has prayed<br \/>\nfor dismissal of the writ petition.\n<\/p>\n<p>I have gone through the pleadings of the parties and<br \/>\nheard their learned counsel.\n<\/p>\n<p>Petitioner&#8217;s plea projected through his counsel, Mr.<br \/>\nSethi that being the lone candidate against the post<br \/>\nreserved for candidates belonging to the Scheduled Caste<br \/>\nCategory, the petitioner was entitled to be selected and<br \/>\nappointed against the post, is misconceived, in view of<br \/>\nthe provisions of Rule 51 of the Jammu and Kashmir<br \/>\nPublic Service Commission (Business and Procedure),<br \/>\nRules 1980 which prescribe in its explanation (Vi) that<br \/>\nfor determination of the suitability of candidates for<br \/>\nappointment, the candidates from Open Category shall<br \/>\nbe required to obtain minimum of 50% marks and those<br \/>\nbelonging to Scheduled Caste\/Scheduled Tribe and other<br \/>\nBackward Classes shall have to obtain minimum of 40%<br \/>\nmarks out of the total marks as given in Rule 51.<br \/>\nHaving failed to obtain minimum of 40% marks out<br \/>\nof the total marks fixed by the Commission, the petitioner<br \/>\nwas not required to be reflected in the select list.<br \/>\nHaving found the petitioner to fall below the<br \/>\nminimum percentage of marks prescribed in Explanation<br \/>\n(Vi) of Rule 51 of the Jammu and Kashmir Public Service<br \/>\nCommission (Business and Procedure), Rules 1980 on<br \/>\nassessment of his merit, the Commission was not under<br \/>\nany obligation to reflect the petitioner&#8217;s name in the<br \/>\nselect list.\n<\/p>\n<p>In view of petitioner&#8217;s failure to secure minimum<br \/>\n40% marks, as assessed by the Commission, the<br \/>\npetitioner is disentitled to seek any command against the<br \/>\nrespondents who have acted in accordance with law in<br \/>\nrejecting his candidature for the post of Lecturer Grade-I<br \/>\n(Computer Science).\n<\/p>\n<p>For all what has been said above, I do not find any<br \/>\nmerit in this petition which is, accordingly, dismissed.<br \/>\nNo costs.\n<\/p>\n<p>(J.P.Singh)<br \/>\nJudge<br \/>\nJammu<br \/>\n20.11.2008<br \/>\nPawan Chopra<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jammu High Court Har Dutt vs State Of J&amp;K &amp; Anr on 20 November, 2008 IN THE HIGH COURT OF JAMMU AND KASHMIR AT JAMMU SWP No. 1601 of 2004 Har Dutt petitioner State of J&amp;K &amp; anr respondents !Mr. Sunil Sethi, Advocate ^Mr. F.
