Justice K.K.DENESAN\n\n Dated :20\/02\/2007\n\n O R D E R\n                           K.K.DENESAN, J.\n\n                   -----------------------------\n\n                        WP(C)No. 5575 OF 2007\n\n                   -----------------------------\n\n               Dated this the 20th February, 2007.\n\n\n\n                                JUDGMENT\n<\/pre>\n<p>      The   petitioner   stands   removed   from   service   by   way   of<\/p>\n<p>penalty   imposed   on   him   on   the   allegation   that   he   was<\/p>\n<p>unauthorisedly absent from duty.\n<\/p>\n<p>      2.  The petitioner commenced service on 1.6.1972.  With<\/p>\n<p>effect from 1.12.1980, on being posted in another place, he<\/p>\n<p>failed to attend duties after just reporting in that office<\/p>\n<p>along   with   the   order   of   transfer.     For   quite   sometime<\/p>\n<p>nothing   was   known   about   him.     After   a   considerable   period<\/p>\n<p>of   time,   he   sought   for   reinstatement   in   service.     The<\/p>\n<p>respondents   took   proceedings   against   him   and   after<\/p>\n<p>observing   the   procedure   prescribed   by   law,   came   to   the<\/p>\n<p>conclusion   that   there   was   no   justification   for   him   to<\/p>\n<p>absent   unauthorisedly.         The   contention   raised   by   the<\/p>\n<p>petitioner   that   he   was   suffering   from   mental   disorder   was<\/p>\n<p>found against.\n<\/p>\n<p>      3.     The   petitioner   approached   this   Court   earlier   in<\/p>\n<p>2001.   Pursuant   to   the   directions   issued   in   that   writ<\/p>\n<p>petition,   the   Government   considered   the   plea   of   the<\/p>\n<p>petitioner.     Ext.P3   order   dated   19.7.2006   has   been   passed<\/p>\n<p>rejecting the representation of the petitioner. Against the<\/p>\n<p>order thus passed,  this writ petition has been filed.\n<\/p>\n<p><span class=\"hidden_text\">WPC  5575\/2007                        2<\/span><\/p>\n<p>      4.     It   is   not   necessary   for   this   Court   to   examine<\/p>\n<p>whether   the   order   removing   him   from   service   is   vitiated   or<\/p>\n<p>any   procedural   illegality   or   non-compliance   of   the<\/p>\n<p>procedure   prescribed   by   law,   because   the   petitioner   admits<\/p>\n<p>in ground &#8216;C&#8217; of the writ petition that he has no case that<\/p>\n<p>legal   formalities   had   not   been   complied   with   before<\/p>\n<p>removing him from service. The only contention urged before<\/p>\n<p>me   is   that   the   respondents   have   failed   to   appreciate   the<\/p>\n<p>materials   made   available   to   make   them   believe   that   he   was<\/p>\n<p>suffering   from   mental   disorder.     I   find   no   merit   in   the<\/p>\n<p>above   contention.     It   has   been   found   that   the   petitioner<\/p>\n<p>failed   to   produce   medical   certificate   in   support   of   the<\/p>\n<p>contention   that   he   was   suffering   from   mental   disorder.     He<\/p>\n<p>produced   a   certificate   said   to   have   been   issued   by   one<\/p>\n<p>T.K.Pappu   Vaidyar,   which   document   on   scrutiny   by   the<\/p>\n<p>departmental authority did not contain the signature of the<\/p>\n<p>person   who   issued   it,   the   date   on   which   it   was   issued   or<\/p>\n<p>the   nature   of   the   disease   the   petitioner   was   suffering<\/p>\n<p>from.    It  was  also  found  further  said  that  the  Director  of<\/p>\n<p>Panchayats   had   recorded   in   his   order   dated   2.6.1984   that<\/p>\n<p>the   petitioner   had,   in   fact,   gone   to   the   office   of   the<\/p>\n<p>Deputy   Director   of   Panchayats   one   day   during   the   relevant<\/p>\n<p>period and was found not suffering from any mental ailment.\n<\/p>\n<p>The  presence   of   the   petitioner   in   the   office   of   the   Deputy<\/p>\n<p>Director   of   Panchayats   on   the   aforesaid   date   assumes<\/p>\n<p><span class=\"hidden_text\">WPC  5575\/2007                                          3<\/span><\/p>\n<p>significance   because   according   to   the   petitioner,   during<\/p>\n<p>that period, he was suffering from mental disorder.\n<\/p>\n<p>      5.     It   is   trite   that   this   Court   will   not   reappreciate<\/p>\n<p>the   evidence   or   materials   leading   to   conclusions   on<\/p>\n<p>disputed         questions                of         fact         under         Art.226         of         the<\/p>\n<p>Constitution of India.   Even if I propose to embark on such<\/p>\n<p>unwelcome             areas,         I          find         materials               justifying            the<\/p>\n<p>conclusions   reached   against   the   petitioner   and   find   no<\/p>\n<p>error,  factual   and   legal,     apparent   on   the   face   of   Ext.P3.\n<\/p>\n<p>I   am   of   the   view   that   the   Government   have   considered   the<\/p>\n<p>case   of   the   petitioner   on   merits   and   with   due   application<\/p>\n<p>of   mind,   though   the   petitioner   had   approached   the<\/p>\n<p>departmental authorities after a long lapse of time.\n<\/p>\n<p>      6.     The   fervent   request   made   by   the   counsel   for   the<\/p>\n<p>petitioner   that   Ext.P3   may   be   set   aside   and   the   Government<\/p>\n<p>may   be   directed   to   re-consider   the   matter   once   again,   does<\/p>\n<p>not   appeal   to   me   for   reasons   aforesaid,   as   the   proper<\/p>\n<p>course   of   action   this   Court   is   expected   to   follow   in   a<\/p>\n<p>matter   of   this   nature.
