DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/04\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\nbeing a successive bail application preferred by the petitioner with<br \/>\ncontention that the offences are  triable  by a Magistrate,  the<br \/>\npetitioner is in jail  since last six years or so and all other<br \/>\naccused are on bail and, therefore,  the present petitioner may be<br \/>\nenlarged on bail.\n<\/p>\n<p>2.\t\tThis<br \/>\ncourt,  (Coram:  Anant S Dave, J.)  by  order dated 23.3.2009  while<br \/>\nrejecting the application for temporary bail, in para 6,  observed as<br \/>\nunder:\n<\/p>\n<p>&#8220;6.\n<\/p>\n<p> Having heard the learned counsel appearing for the parties and on<br \/>\ngoing through the record of the case, what transpires is that regular<br \/>\nbail sought for by the applicant was already rejected by order dated<br \/>\n28.9.2004 but after taking into consideration the willingness on the<br \/>\npart of the applicant at the relevant point of time to discharge the<br \/>\nliability of the complainant-bank and in view of the fact that the<br \/>\ntrial is likely to take time, temporary bail was granted to the<br \/>\napplicant, which was finally extended from 29.3.2008 to 30.03.2009.<br \/>\nDuring the period of temporary bail, when the applicant came to be<br \/>\nreleased first time on 6.1.2007, after period of five months, on<br \/>\n14.6.2007 the efforts made by the applicant also failed. For the<br \/>\nallegations levelled against the applicant in the capacity of<br \/>\nChairman of Home Trade Corporation etc., attracting ingredients of<br \/>\noffences punishable under sections 465, 467, 468, 471, 420 read with<br \/>\nsection 114 and 120B of the Indian Penal Code, the punishment, if<br \/>\nconvicted, may extend upto life imprisonment.  The nature of<br \/>\nallegations and role attributed qua the applicant in commission of<br \/>\noffence, prima facie reveal about the systematic fraud misleading<br \/>\ngullible investors to invest in government securities including Banks<br \/>\nfor which offences are registered of serious nature and punishment is<br \/>\nupto life imprisonment.  Details discussion or reasoning on that<br \/>\naspect at this state is not necessary.&#8221;\n<\/p>\n<p>At<br \/>\nthat time also the petitioner was under-trial prisoner for about 51<br \/>\nmonths and considering the well reasoned submissions of the learned<br \/>\nAdvocates for the applicant, this court had rejected the petition<br \/>\nagainst which Special Leave Petition was preferred before the Supreme<br \/>\nCourt being Criminal Misc.Petition No.14610 to 14612 of 2009 which<br \/>\ncame to be withdrawn by order dated 1.9.2009.\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard the learned advocate for the petitioner and on perusal of the<br \/>\nrecord, in my opinion, there is no change of circumstances or law to<br \/>\nconsider this application and release the petitioner on bail except<br \/>\nthe fact that  this application has been preferred  10 months  after<br \/>\nthe earlier order  has been passed.\n<\/p>\n<p>\t\tNo<br \/>\ncase is made out.
