MUKHOPADHAYA)<\/p>\n<p>ORDER<br \/>\nIN MCA:\n<\/p>\n<p>\tIt<br \/>\nappears that the Court&#8217;s order to remove defects as passed on 20th<br \/>\nDecember 2010 having not complied with, Letters Patent Appeal No.<br \/>\n2923 of 2010 was dismissed on 13th January 2010.  Having heard<br \/>\nlearned counsel for the petitioner, and being satisfied with the<br \/>\nexplanation, we allow the petition and restore the Letters Patent<br \/>\nAppeal NO.2923 of 2010 to its original number.\n<\/p>\n<p>ORDER<br \/>\nIN LPA:\n<\/p>\n<p>\tWhen<br \/>\nthe matter was taken up, learned counsel for the appellant submits<br \/>\nthat pursuant to the order passed by the learned Single Judge, the<br \/>\nrepresentation of the respondent was considered and rejected.  Even<br \/>\nthe appeal preferred against said order was also dismissed.<br \/>\nTherefore, the appeal has become infructuous.\n<\/p>\n<p>\tIn<br \/>\nview of the aforesaid fact, no further order is required to be<br \/>\npassed.
