L. Jani, learned Additional Public Prosecutor, waives<br \/>\n\tservice of Rule on behalf of the respondent-State.\n<\/p>\n<p>\tThe applicant-original<br \/>\n\taccused of Special (ACB) Case No.17 of 2002, who is convicted by the<br \/>\n\tlearned Principal District and Sessions Judge, Surat, for the<br \/>\n\toffence punishable under Sections 13(1)(d) and 13(2) of the<br \/>\n\tPrevention of Corruption Act, has filed the present application for<br \/>\n\tbail. Under Section 7 of the Prevention of the Corruption Act the<br \/>\n\tapplicant is sentenced to undergo S.I. for a period of 1 year with<br \/>\n\tfine of Rs.2,000\/- and in default to undergo further 3 months S.I.<br \/>\n\tUnder Section 13(2) of the Prevention of Corruption Act the<br \/>\n\tapplicant is sentenced to undergo S.I. for a period of 2 years with<br \/>\n\tfine of Rs.3,000\/- and in default to undergo further 6 months S.I.\n<\/p>\n<p>\tHeard Mr.B. R. Gupta,<br \/>\n\tlearned counsel for the applicant and Mr.H.L.Jani, learned<br \/>\n\tAdditional Public Prosecutor for the respondent-State.\n<\/p>\n<p>\tMr.Gupta has contended<br \/>\n\tthat the applicant is a public servant and he will be available<br \/>\n\tduring hearing of the appeal. He has contended that fine amount is<br \/>\n\talready deposited. He has, therefore, contended that the application<br \/>\n\tmay kindly be allowed by releasing the applicant on bail pending the<br \/>\n\tappeal.\n<\/p>\n<p>\tI have gone through the<br \/>\n\tpapers produced before me as well as the judgment and order passed<br \/>\n\tby the learned Principal District and Sessions Judge, Surat.\n<\/p>\n<p>\tLooking to the facts of<br \/>\n\tthe case, I am of the opinion that this is a fit case to grant the<br \/>\n\tbail to the applicant. Hence, the applicant is ordered to be<br \/>\n\treleased on bail pending hearing and disposal of the main appeal on<br \/>\n\this furnishing a personal bond of Rs.10,000\/- and a surety of the<br \/>\n\tlike amount on usual terms and conditions.
