1.      The \u00a0 Applicant \u00a0 filed \u00a0 his \u00a0 RTI\u00adapplication \u00a0 with \u00a0 the \u00a0 Secretary, \u00a0 DoPT, \u00a0 North \u00a0 Block, \u00a0 New \u00a0 Delhi \u00a0 on\u00a0<\/p>\n
        04.07.2006\u00a0raising\u00a0several\u00a0queries\u00a0\u00a0with\u00a0regard\u00a0\u00a0to\u00a0re\u00adfixation\/stepping\u00a0up\u00a0of\u00a0\u00a0of\u00a0revised\u00a0new\u00a0as\u00a0on\u00a0<\/p>\n
        1.1.1986\u00a0.\u00a0In\u00a0response\u00a0to\u00a0this\u00a0application,\u00a0Shri\u00a0Chandra\u00a0Prakash,\u00a0Under\u00a0Secretary,\u00a0on\u00a018.07.2006,\u00a0<\/p>\n
        provided\u00a0            to\u00a0the\u00a0Applicant\u00a0the\u00a0required\u00a0information\/clarification\u00a0on\u00a0the\u00a0matter.\u00a0\u00a0The\u00a0Applicant,\u00a0<\/p>\n
                  however, \u00a0 being \u00a0 dissatisfied \u00a0 with \u00a0 the \u00a0 information\/clarification \u00a0 furnished \u00a0 to \u00a0 him, \u00a0 filed \u00a0 the\u00a0<\/p>\n
        present\u00a0petition\u00a0in\u00a0the\u00a0Commission\u00a0on\u00a022.03.2010\u00a0narrating\u00a0his\u00a0case\u00a0of\u00a0re\u00adfixation\u00a0of\u00a0his\u00a0basic\u00a0pay.<\/p>\n
Decision\u00a0<\/p>\n
2.      During\u00a0the\u00a0hearing,\u00a0the\u00a0Complainant\u00a0complained\u00a0that\u00a0\u00a0the\u00a0reply\u00a0given\u00a0to\u00a0him\u00a0has\u00a0been\u00a0\u00a0signed\u00a0by\u00a0an\u00a0<\/p>\n
        Under\u00a0Secretary\u00a0and\u00a0not\u00a0by\u00a0the\u00a0CPIO\u00a0and,\u00a0therefore,\u00a0it\u00a0cannot\u00a0be\u00a0treated\u00a0as\u00a0a\u00a0valid\u00a0reply\u00a0under\u00a0the\u00a0<\/p>\n
        RTI\u00adAct \u00a0 and \u00a0 also \u00a0 that \u00a0 it \u00a0 does \u00a0 not\u00a0 indicate\u00a0 the\u00a0 details\u00a0 of\u00a0 the\u00a0 Appellate\u00a0 Authority\u00a0 with\u00a0 whom\u00a0 the\u00a0<\/p>\n
        Complainant’s\u00a01st\u00adappeal\u00a0would\u00a0lie.\u00a0\u00a0He\u00a0also\u00a0stated\u00a0that\u00a0\u00a0the\u00a0contents\u00a0of\u00a0the\u00a0said\u00a0reply\u00a0do\u00a0not\u00a0deal\u00a0with\u00a0<\/p>\n
        the\u00a0queries\/grievance\u00a0which\u00a0have\u00a0put\u00a0forth\u00a0by\u00a0him\u00a0in\u00a0his\u00a0RTI\u00adapplication,\u00a0but\u00a0just\u00a0reflects\u00a0the\u00a0version\u00a0<\/p>\n
        of \u00a0 the \u00a0 reply \u00a0 furnished \u00a0 by \u00a0 the \u00a0 Central\u00a0 Bureau\u00a0 of \u00a0 \u00a0 Investigation \u00a0 (CBI), \u00a0 from\u00a0 where \u00a0 he\u00a0 had \u00a0 taken\u00a0<\/p>\n
        Voluntary\u00a0Retirement\u00a0from\u00a0his\u00a0service,\u00a0to\u00a0DoPT.\u00a0\u00a0\n<\/p>\n<\/p>\n
3.      It\u00a0is\u00a0evident\u00a0from\u00a0the\u00a0averments\u00a0as\u00a0given\u00a0hereinabove\u00a0\u00a0that\u00a0the\u00a0Complainant\u00a0is\u00a0having\u00a0a\u00a0grievance\u00a0<\/p>\n
        against\u00a0the\u00a0DoPT–the\u00a0Respondents–for\u00a0not\u00a0considering\u00a0his\u00a0case\u00a0of\u00a0re\u00adfixation\u00a0of\u00a0his\u00a0pay\u00a0despite\u00a0his\u00a0<\/p>\n
        repeated\u00a0requests\u00a0to\u00a0them\u00a0over\u00a0the\u00a0years\u00a0and\u00a0that,\u00a0he\u00a0presently\u00a0through\u00a0the\u00a0RTI\u00adAct\u00a0wants\u00a0them\u00a0to\u00a0<\/p>\n
        take\u00a0a\u00a0decision\u00a0on\u00a0his\u00a0said\u00a0request.\u00a0\n<\/p>\n
 4.      Although\u00a0I\u00a0sympathize\u00a0with\u00a0the\u00a0Complainant\u00a0who\u00a0is\u00a0a\u00a0senior\u00a0citizen,\u00a0I\u00a0would\u00a0like\u00a0to\u00a0admit\u00a0that\u00a0\u00a0under\u00a0<\/p>\n
        the\u00a0RTI\u00a0Act\u00a0there\u00a0is\u00a0nothing\u00a0more\u00a0I\u00a0can\u00a0do\u00a0in\u00a0this\u00a0regard\u00a0\u00a0besides\u00a0allowing\u00a0the\u00a0disclosure\u00a0of\u00a0available\u00a0<\/p>\n
        information\u00a0in\u00a0material\u00a0form\u00a0as\u00a0stipulated\u00a0under\u00a0Section\u00a02(f)\u00a0of\u00a0the\u00a0RTI\u00a0Act,)–that\u00a0is\u00a0in\u00a0the\u00a0present\u00a0<\/p>\n
        case\u00a0‘the\u00a0action\u00a0taken\u00a0by\u00a0the\u00a0public\u00a0authority’\u00a0viz.,\u00a0DoPT\u00a0on\u00a0his\u00a0request\u00a0for\u00a0re\u00adfixation\u00a0of\u00a0his\u00a0basic\u00a0pay.\u00a0<\/p>\n
        It\u00a0is\u00a0accordingly\u00a0directed\u00a0that\u00a0the\u00a0CPIO\u00a0shall\u00a0formally\u00a0inform\u00a0the\u00a0Complainant\u00a0the\u00a0action\u00a0taken\u00a0by\u00a0the\u00a0<\/p>\n
        public\u00a0authority\u00a0on\u00a0his\u00a0request\u00a0for\u00a0re\u00adfixation\u00a0of\u00a0his\u00a0basic\u00a0pay\u00a0and,\u00a0in\u00a0case\u00a0no\u00a0action\u00a0is\u00a0found\u00a0to\u00a0be\u00a0<\/p>\n
