Justice M.SASIDHARAN NAMBIAR\n\n Dated :24\/11\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n            ---------------------------------------------\n            CRL.M.C.NO.4370 OF 2010\n            ---------------------------------------------\n            Dated 24th November, 2010\n\n                           O R D E R\n<\/pre>\n<pre>           Petitioner              was       sixth       accused  in\n\nS.C.966\/2003    on        the         file          of    Additional\n\n<\/pre>\n<p>Sessions Court, Mavelikara. As petitioner and<\/p>\n<p>sixth accused were absconding, case against<\/p>\n<p>them  was  split        up       and        re-filed        and  the<\/p>\n<p>remaining  six       accused                   were       tried. By<\/p>\n<p>Annexure-A3   judgment               those            accused   were<\/p>\n<p>acquitted. Subsequently, when presence of the<\/p>\n<p>petitioner was procured, case against him was<\/p>\n<p>taken on file as S.C.875\/2010. Petition is<\/p>\n<p>filed under Section 482 of Code of Criminal<\/p>\n<p>Procedure to    quash          the proceedings pending<\/p>\n<p>against him contending that in view of the<\/p>\n<p>order of acquittal against the co-accused and<\/p>\n<p>the  findings    in       Annexure-A3                judgment   that<\/p>\n<p>prosecution case is shrouded                         in    suspicion<\/p>\n<p><span class=\"hidden_text\">Crmc 4370\/10              2<\/span><\/p>\n<p>even if, petitioner is to be tried, there is no<\/p>\n<p>likelihood     of  a  successful  prosecution  and<\/p>\n<p>therefore, the case is to be quashed.<\/p>\n<p>            2. On hearing the    learned   counsel<\/p>\n<p>and the learned Public Prosecutor,       I cannot<\/p>\n<p>agree with the      learned  counsel appearing for<\/p>\n<p>the     petitioner that based on the findings in<\/p>\n<p>Annexure-A3      that  the  prosecution  case   is<\/p>\n<p>shrouded in suspicion or for the reason that<\/p>\n<p>the co-accused were acquitted, the case could<\/p>\n<p>be quashed, in view of the Full Bench of this<\/p>\n<p>Court in <a href=\"\/doc\/217622\/\">Moosa v. Sub Inspector of Police<\/a> (2006<\/p>\n<p>(1) KLT 552). Though      learned   counsel argued<\/p>\n<p>that        PW8  when  examined  in  S.C.966\/2003,<\/p>\n<p>against      whom  an  overt  act   was  allegedly<\/p>\n<p>committed by the petitioner as per Annexure-A2<\/p>\n<p>final report, did not give any such evidence<\/p>\n<p>and     therefore,   there is  no   necessity  for<\/p>\n<p>directing the petitioner to undergo the ordeal<\/p>\n<p><span class=\"hidden_text\">Crmc 4370\/10               3<\/span><\/p>\n<p>of a trial, when petitioner was not appearing<\/p>\n<p>in that case there was no necessity for Public<\/p>\n<p>Prosecutor to elicit the evidence against the<\/p>\n<p>petitioner,      in  that  case.  Hence  failure  to<\/p>\n<p>mention      the  overt  act  on  the  part  of  the<\/p>\n<p>petitioner by that witness when examined in<\/p>\n<p>S.C.966\/2003, is not a ground to quash the<\/p>\n<p>proceedings. Petitioner is entitled to raise<\/p>\n<p>all the contentions raised herein before the<\/p>\n<p>learned Sessions Judge and seek an order of<\/p>\n<p>discharge.
