RAJENDRA BABU &amp; RUMA PAL.\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>RAJENDRA BABU, J. :\n<\/p>\n<p>\tThe second respondent is a recognized aided<br \/>\nschool of the Government of Tamil Nadu.  Such<br \/>\nschools are governed by Tamil Nadu Recognized<br \/>\nPrivate Schools (Regulation) Act, 1973 and rules<br \/>\nframed thereunder.  All the posts coming within<br \/>\nthe Private schools are to be filled up in<br \/>\naccordance with the provisions contained in the<br \/>\nsaid Act or Rules framed thereto.  The<br \/>\nmanagement of school appointed the first<br \/>\nappellant as the Head Master.  The second<br \/>\nrespondent filed an appeal before the Appellate<br \/>\nAuthority challenging the appellant&#8217;s appointment.<br \/>\nThe Appellate Authority held that the appellant<br \/>\nwas not holding a post as P.G. Assistant which is<br \/>\nthe feeder category and, therefore, his<br \/>\nappointment as Head Master was bad and set<br \/>\naside the same.  Against that order, appellant<br \/>\npreferred a writ petition before the High Court and<br \/>\nthe learned Single Judge dismissed the same<br \/>\nagainst which writ appeal was also filed.  The<br \/>\nconcurrent view of Appellate Authority and learned<br \/>\nSingle Judge or Division Bench of the High Court is<br \/>\nthat respondent No.2 is the senior most Post<br \/>\nGraduate Assistant and he belongs to the feeder<br \/>\ncategory to the post of Head Master; that he had<br \/>\nbeen appointed as a Post Graduate Assistant on<br \/>\nregular basis and had been holding the post of<br \/>\nAssistant Head Master; that the appellant is not<br \/>\nfully qualified Post Graduate Assistant; that he<br \/>\ndoes not belong to the Post Graduate Assistant in<br \/>\nacademic subject or languages; and that he does<br \/>\nnot belong to feeder category at all; that he is not<br \/>\nentitled to be promoted as Head Master ignoring<br \/>\nthe claim of the second respondent.<br \/>\n\tIn order to find out whether the view taken<br \/>\nby the High Court and the Tribunal is erroneous, it<br \/>\nis necessary to examine the matter with reference<br \/>\nto the relevant rules.  Rule 15(4)(i)(d) provides<br \/>\nthat the post of Head Master could be filled up<br \/>\nonly amongst the categories stated therein and<br \/>\nthey are from the category of (1) Head Masters of<br \/>\nHigh schools; (2) Post Graduate Assistants in<br \/>\nacademic subjects; (3) Post Graduate Assistants in<br \/>\nlanguages provided that they possess the<br \/>\nprescribed qualifications.  It cannot be seriously<br \/>\ndisputed that the appellant is not a Post Graduate<br \/>\nAssistant and he does not come under the feeder<br \/>\ncategory.  Merely because he possesses the<br \/>\nnecessary qualifications by itself will not enable<br \/>\nhim to claim to be appointed as a Head Master.  It<br \/>\nis on this basis the Appellate Authority, the<br \/>\nlearned Single Judge of the High Court held that<br \/>\nthe appellant is not entitled to be appointed as the<br \/>\nHead Master.\n<\/p>\n<p>\tThe claim made by appellant is that he<br \/>\npossesses Master&#8217;s degree in History but he had<br \/>\nnot undergone the regular course but in a<br \/>\ncondensed course conducted by the Department<br \/>\nitself for a period of 10 months and his degree is<br \/>\nconferred by way of certificate and such teachers<br \/>\nare held to be not in the feeder category so as to<br \/>\nbecome eligible to be appointed as Head Master.<br \/>\nSuch arrangement of giving certificates to certain<br \/>\nteachers became necessary as there was dearth of<br \/>\nPost Graduate teachers being available in the<br \/>\nHigher Secondary Schools such as that of the<br \/>\nsecond appellant.  Thus he becomes an inducted<br \/>\nteacher and not a regular teacher in the cadre.<br \/>\nBearing these aspects in mind and Appellate<br \/>\nAuthority as well as the High Court, have taken a<br \/>\nview, we do not find this matter calls for<br \/>\ninterference in a proceeding arising under Article<br \/>\n136 of the Constitution.\n<\/p>\n<p>Hence we dismiss this appeal.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India S.
