Civil Judge [S.D.], Rajkot in Regular Civil Suit No. 668 of 1992.\n<\/p>\n<p>2.\tShort<br \/>\nfacts of the case are that, the respondent no.1 -original plaintiff<br \/>\nfiled Regular Civil Suit No. 668 of 1992 praying that the name of the<br \/>\nplaintiff be entered in the record of rights after doing new survey<br \/>\nas per his actual possession, and for declaration that the plaintiff<br \/>\nis owner of the land-field admeasuring about 2 Acres and 16 Gunthas.<br \/>\nThe  suit of the plaintiff was decreed with costs by judgment and<br \/>\ndecree dated  29.1.1998  passed by the learned 2nd Joint<br \/>\nCivil Judge [S.D.], Rajkot. Being aggrieved and dissatisfied with the<br \/>\nsaid judgment and decree, original defendant no.1-appellant herein,<br \/>\npreferred Regular Civil Appeal No. 60 of 2002 in the District Court,<br \/>\nRajkot, which was  rejected by the learned Additional District Judge<br \/>\n[Fast Track Court No.5], Rajkot and the judgment and decree passed by<br \/>\nthe lower court was confirmed.\n<\/p>\n<p>3.<br \/>\n\tMs VS Pathak, learned Asstt. Government Pleader appearing for the<br \/>\nappellant-State of Gujarat, submitted that both the courts below have<br \/>\ncommitted an error in not properly appreciating the evidence on the<br \/>\nrecord of the case. The courts below have also not considered that<br \/>\nrespondent no.1 -original plaintiff encroached upon the govt. waste<br \/>\nland and, therefore, the suit ought not to have been decreed by the<br \/>\ntrial court and confirmed in appeal by the appellate court. Both the<br \/>\ncourts below have not interpreted the document Exh.67 and, therefore,<br \/>\nthe order passed by the courts below deserve to be quashed and set<br \/>\naside.\n<\/p>\n<p>4.<br \/>\n\tMr R.C. Kakkad, learned advocate appearing for main contesting<br \/>\nrespondent no.1-original plaintiff, submitted that the trial court<br \/>\nhas taken into consideration the evidence adduced before it in the<br \/>\nright perspective and after  considering the same, the trial court<br \/>\nhas decreed the suit of the plaintiff which was confirmed in appeal<br \/>\nby the  appellate court and as no infirmity is committed in the<br \/>\nfinding of the courts below, no interference under Sec.100 of CPC is<br \/>\ncalled for  and the appeal deserves to be dismissed as no substantial<br \/>\nquestion of law is involved in the appeal.\n<\/p>\n<p>5.<br \/>\n\tHeard Ms VS Pathak, learned AGP for the appellant and Mr RC Kakkad<br \/>\nas well as Mr Nishant Lalakiya, learned advocates for respondent no.1<br \/>\nand respondent nos. 2.2.1 to 2.2.6 respectively at length and in<br \/>\ngreat detail. I have considered the reasoning given by the  courts<br \/>\nbelow. I have also perused the record and proceedings of the case as<br \/>\nwell as documentary evidence which is adduced in the present case.<br \/>\nThe deposition adduced by  Surveyor R.V. Shukla as well as<br \/>\nmeasurements made by him  and produced at Exh.41 are considered by<br \/>\nme. Considering the aforesaid aspect, the trial court has held that<br \/>\nperusing the said documents, the disputed property was in the name of<br \/>\nNatha Bhaga. It is further held that Talati had also led evidence<br \/>\nindicating that the disputed property was in possession of Natha<br \/>\nBhaga. Initially, Mamlatdar had not allowed the suit of the plaintiff<br \/>\nand, therefore, the Revenue Department had remanded the case back and<br \/>\non remand, the Deputy Collector had made an inquiry under Section<br \/>\n37[2] of the Bombay Land Revenue Code. Both the Collector and Deputy<br \/>\nCollector held that two fields with way of Chopat and Vada are<br \/>\nsituated adjoining to each other and considering the occupancy<br \/>\ncertificate, the trial court has held that the plaintiff has proved<br \/>\nhis case by adducing cogent  evidence in the matter and decreed the<br \/>\nsuit which  was confirmed in the appeal by the appellate court by<br \/>\nassigning reasons. Considering the concurrent findings of fact given<br \/>\nby the courts below on the basis of the detailed evidence, and since<br \/>\nthe appeal does not involve any substantial questions of law,  I am<br \/>\nof the view that no interference is called for in the present appeal<br \/>\nand it deserves to be dismissed.\n<\/p>\n<p>6.<br \/>\n\tFor the foregoing reasons, there is no merit in the appeal and  the<br \/>\nsame is dismissed.
