Kindly provide me the details of every property (including<br \/>\n                roads, streets, lands, buildings, other structures etc), which<br \/>\n                belongs to you or to any public authority on the given map<br \/>\n                but has been partially or fully encroached upon or illegal<br \/>\n                construction done. For each property, the details should<br \/>\n                include the following:\n<\/p><\/blockquote>\n<blockquote><p>                              a) Address of the property.\n<\/p><\/blockquote>\n<blockquote><p>                              b) Whether it is encroachment or illegal<br \/>\n                                  construction or both.\n<\/p><\/blockquote>\n<blockquote><p>                              c) Name and address of the person\/ company<br \/>\n                                  who has encroached upon the property or<br \/>\n                                  done illegal construction.\n<\/p><\/blockquote>\n<blockquote><p>                              d) Type of encroacher viz. individual,<br \/>\n                                  company, NGO, government body, etc.\n<\/p><\/blockquote>\n<blockquote><p>                              e) Total area in square feet or square metres<br \/>\n                                  that has been encroached upon or built.\n<\/p><\/blockquote>\n<blockquote><p>                              f) Whether the area is an environmentally<br \/>\n                                  protected area.\n<\/p><\/blockquote>\n<blockquote><p>                              g) Market value of the area encroached upon.\n<\/p><\/blockquote>\n<blockquote><p>                              h) Type of structure constructed.\n<\/p><\/blockquote>\n<blockquote><p>                              i) Estimated time it would take to construct<br \/>\n                                  such a structure.\n<\/p><\/blockquote>\n<blockquote><p>                              j) The date on which the encroached or illegal<br \/>\n                                  construction came to your notice.\n<\/p><\/blockquote>\n<blockquote><p>                              k) How did it come to your notice?\n<\/p><\/blockquote>\n<blockquote><p>                              l) Detail the steps taken by you to reclaim\/<br \/>\n                                  repossess     property     and   evict   the<br \/>\n                                  encroacher or to demolish the illegal<br \/>\n                                  construction.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                            1<\/span><\/p>\n<blockquote><p>                              m) The date on which you took the first step<br \/>\n                                towards evicting the encroacher or<br \/>\n                                demolishing the illegal construction.\n<\/p><\/blockquote>\n<blockquote><p>                             n) If you have not taken any steps, please<br \/>\n                                explain why you have not done so.\n<\/p><\/blockquote>\n<blockquote><p>                             o) Did you take any legal action?\n<\/p><\/blockquote>\n<blockquote><p>                             p) If yes, please provide the date the action<br \/>\n                                was initiated.\n<\/p><\/blockquote>\n<blockquote><p>                             q) If no legal action has been taken, then<br \/>\n                                explain why you have not done so.\n<\/p><\/blockquote>\n<blockquote><p>                             r) Current case no. and court details.\n<\/p><\/blockquote>\n<blockquote><p>                             s) Total legal cost incurred so far.\n<\/p><\/blockquote>\n<blockquote><p>                             t) Correct activity running at the property.<br \/>\n                             u) Was any clearance\/ permission granted by<br \/>\n                                you to commence\/ continue the activity.\n<\/p><\/blockquote>\n<blockquote><p>                             v) If yes, how and why was the clearance or<br \/>\n                                permission given?<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>                             w) Is electricity installed there? If yes, please<br \/>\n                                provide K. No.<\/p>\n<p>      2      I would like to inspect those portions of all of the above<br \/>\n             properties that have been encroached upon or illegally<br \/>\n             constructed. Kindly advise me a venue where to start the<br \/>\n             inspection from and also advise the date, time and name\/<br \/>\n             contact- details of the official who will meet me for the<br \/>\n             purpose.&#8221;<\/p><\/blockquote>\n<p>          To this he received a response dated 3.5.07 from Shri Jai Chandra,<br \/>\n   Executive Engineer (UACC), dissatisfied with which, he moved an appeal<br \/>\n   before Director (UACC), NDMC on 13th May, 2007 upon which he received an<br \/>\n   order from Shri Sanjib Sengupta First Appellate Authority UACC NDMC dated<br \/>\n   26.6.07, against which he has moved this appeal before us on 8.11.07.Having<br \/>\n   admitted the appeal, however, we have received a letter of 16.2.09 from<br \/>\n   appellant Shri Rakesh Agarwal stating as follows:<br \/>\n      &#8220;It appears that you have registered my appeal twice. The matter<br \/>\n      has already been heard and decided under appeal No.<br \/>\n      CIC\/WB\/A\/2007\/01484.&#8221;\n<\/p>\n<p>                                DECISION NOTICE<\/p>\n<p>    On     verifying   our   records,    we   find   that   appeal    in   File   No.<br \/>\nCIC\/WB\/A\/2007\/001560 is indeed a duplicate of the appeal heard, as mentioned<\/p>\n<p><span class=\"hidden_text\">                                          2<\/span><br \/>\n by appellant, in File No. CIC\/WB\/A\/2007\/01484, which stands, decided on<br \/>\n23.1.2009. In that case we had directed as follows:\n<\/p>\n<blockquote><p>      &#8220;From the facts above, it appears that this is a case of malafide<br \/>\n      denial of Information by the PIO. However since it is the<br \/>\n      responsibility of the First Appellate Authority to ensure that the<br \/>\n      orders passed by it are duly complied with by the PIO, the<br \/>\n      Commission, therefore, has decided to remand the case back to<br \/>\n      the Appellate Authority Ms. Ranjana Deswal, Director, NDMC to<br \/>\n      ensure that its orders under section 19(1) are duly complied with<br \/>\n      and the requested information furnished in terms of the order so<br \/>\n      passed, with the qualification that now, in accordance with Sec 7(6)<br \/>\n      of the RTI Act, 2005, no fees will be charged.\n<\/p><\/blockquote>\n<blockquote><p>      If the compliance is not ensured within 15 days from the date of<br \/>\n      receipt of this order, the FAA Mrs. Ranjana Deswal, Director,<br \/>\n      NDMC should approach this Commission for initiation of<br \/>\n      proceedings under section 20 of the RTI Act for imposition of<br \/>\n      penalty and\/or recommending appropriate disciplinary action. This<br \/>\n      will be without prejudice to the right of the First Appellate Authority<br \/>\n      to initiate other penal action under the Indian Penal Code against<br \/>\n      the PIO for wilful violation of lawful orders promulgated by a public<br \/>\n      servant while exercising statutory powers.\n<\/p><\/blockquote>\n<blockquote><p>      Appellant had also complained of the lack of response in the PIO&#8217;s<br \/>\n      office to which he had to make approaches simply to have his<br \/>\n      application received. Mrs. Ranjana Deswal will, therefore, ensure<br \/>\n      that the processes in the office of Executive Engineer, UACC are<br \/>\n      brought into full compliance with the requirements of the RTI Act in<br \/>\n      servicing the application from citizens, so that citizens are not<br \/>\n      submitted to unnecessary inconvenience in submitting applications<br \/>\n      in future. This Appeal now stands disposed of.&#8221;<\/p><\/blockquote>\n<p>     That Appeal now stands disposed of. In light of the above, the present<br \/>\nappeal having already been disposed of is infructuous and will now abate.\n<\/p>\n<p>      Announced in open chambers.
