(1) 500 JT 1993  Supl.    594\n 1993 SCALE  (4)418\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>The Judgment of the Court was delivered by<br \/>\nMOHAN,\tJ.-  By\t this  petition\t under\tArticle\t 32  of\t the<br \/>\nConstitution  of India, the petitioner sought a writ in\t the<br \/>\nnature\tof  habeas corpus to produce Smt Nidhi\tBagga  Nidhi<br \/>\nKhandelwal w\/o Charanjit Singh Bagga.\n<\/p>\n<p>2.   Nidhi Khandelwal and Charanjit Singh Bagga got  married<br \/>\non  July  16, 1993 by performing Hindu rites at\t Arya  Samaj<br \/>\nMandir, Arya Nagar, Bhoor, Distt.  Bareilly, Uttar  Pradesh.<br \/>\nThat  marriage\twas not acceptable to the  family  of  Nidhi<br \/>\nKhandelwal.   Therefore, on July 17, 1993 an FIR was  lodged<br \/>\nwith  Police  Station Prem Nagar, Bareilly.   The  case\t was<br \/>\nregistered   as\t Case  No.  635\t of  1993   under   Sections<br \/>\n363\/366\/506 IPC.  After the registration of case, the entire<br \/>\nfamily of the husband was taken into custody including minor<br \/>\ngirls  aged 10 and 15 1\/2 years.  While the  female  members<br \/>\nwere   released,  the  male  members  continued\t to  be\t  in<br \/>\ndetention.   Smt  Nidhi Bagga continued to be  held  by\t the<br \/>\npolice and illegally detained.\n<\/p>\n<p>3.   Though a writ petition was filed before the High  Court<br \/>\nof Allahabad under Article 226 of the Constitution of India,<br \/>\non  account of the lawyers strike, the Allahabad High  Court<br \/>\ndid not function.  This necessitated the cousin of Charanjit<br \/>\nSingh  Bagga  to  move this Court under Article\t 32  of\t the<br \/>\nConstitution of India.\n<\/p>\n<p>\t      4.    On\tAugust 3, 1993, the following  order<br \/>\n\t      was passed by this Court<br \/>\n\t      &#8220;We have heard learned counsel on both  sides.<br \/>\n\t      At  the time the petition was moved, the\tgirl<br \/>\n\t      was  in  police custody.\tShe has\t since\tbeen<br \/>\n\t      released.\t But, we are afraid, this cannot  be<br \/>\n\t      the  end\tof the matter.\t The  writ  petition<br \/>\n\t      shall  continue  as one for  qualified  habeas<br \/>\n\t      corpus  for  examining  the  legality  of\t the<br \/>\n\t      detention\t  for\tdetermining   whether\t the<br \/>\n\t      petitioner is entitled to be<br \/>\n\t      +\t    Under Article 32 of the Constitution  of<br \/>\n\t      India<br \/>\n<span class=\"hidden_text\">\t      501<\/span><br \/>\n\t      compensated  for\tthe illegal detention  as  a<br \/>\n\t      public  law   remedy  for\t violation  of\t her<br \/>\n\t      Fundamental  Rights  under Article 21  of\t the<br \/>\n\t      Constitution,  quite  apart from\tcriminal  or<br \/>\n\t      civil  liability which may be pursued  in\t the<br \/>\n\t      ordinary course.\n<\/p>\n<p>\t      The   respondents\t are  directed\tto  file   a<br \/>\n\t      counter-affidavit within two weeks.\n<\/p>\n<p>\t      At  the  request\tof Mr  R.S.  Sodhi,  learned<br \/>\n\t      counsel  for  the petitioner,  notice  against<br \/>\n\t      respondent 3 is discharged.&#8221;\n<\/p>\n<p>5.   In\t obedience to this order, the Station House  Officer<br \/>\n(J.C.  Upadhyaya)  has filed  a\t counter-affidavit  strongly<br \/>\ndenying that Mrs Nidhi Khandelwal alias Nidhi Bagga was ever<br \/>\narrested or detained by the police, much less illegally.  On<br \/>\nJuly  17, 1993 Vikas Khandelwal brother of Nidhi  Khandelwal<br \/>\nlodged an FIR for offences punishable under Sections 363\/366<br \/>\nIPC   alleging\tthat  Charanjit\t Singh\talias\tChanni\t had<br \/>\nkidnapped\/abducted his minor sister Nidhi aged 16 years with<br \/>\nthe  connivance of other named co-accused persons.   On\t the<br \/>\nbasis  of that FIR, Case No. 635 of 1993 was  registered  at<br \/>\nPolice\tStation Prem Nagar on July 17, 1993 against  various<br \/>\npersons\t   including   Charanjit   Singh   Bagga.     During<br \/>\ninvestigation, the abducted girl Mrs Nidhi was recovered  by<br \/>\nthe police of Prem Nagar on July 24, 1993 at 4.30 p.m.\tfrom<br \/>\nBareilly  Junction  Railway Station in the  company  of\t two<br \/>\naccused persons and they were brought to the Police Station,<br \/>\nPrem  Nagar,  Bareilly.\t The accused persons  were  produced<br \/>\nbefore the Magistrate who remanded them to judicial  custody<br \/>\non July 25, 1993.\n<\/p>\n<p>6.   Soon  thereafter,, Mrs Nidhi was brought to the  Police<br \/>\nStation Prem Nagar on July 24, 1993 at 5.30 p.m., her mother<br \/>\nSmt  Seema  Khandelwal was informed of\ther  recovery.\t Her<br \/>\nmother\tand brother came to the police station.\t  Mrs  Nidhi<br \/>\nhad  to\t be  medically examined for  ascertaining  her\tage.<br \/>\nMeanwhile,  it was noticed that lot of people  belonging  to<br \/>\nSikh  community\t had  gathered around  the  police  station.<br \/>\nThere  was  reasonable apprehension that the girl  might  be<br \/>\nsnatched  and  forcibly\t taken away by the  people  of\tSikh<br \/>\ncommunity.   Therefore,\t it  was  considered  necessary\t and<br \/>\nproper\tthat she be allowed to stay in Police  Station\tPrem<br \/>\nNagar along with her mother.  This was agreed to by both the<br \/>\nmother and brother.  On the next day i.e. on July 25,  1993,<br \/>\nNidhi was sent for radiological examination.  Since it was a<br \/>\nSunday,\t the Radiology Department was not working.  So,\t she<br \/>\nwas brought back to the police station.\t Thereafter, on July<br \/>\n26,  1993  she was sent for radiological  examination.\t All<br \/>\nthese  are mentioned in G.D. reports.  Then Nidhi came\tback<br \/>\nto  police station after radiological examination  with\t her<br \/>\nmother\tand  lady  constable who had  escorted\ther  to\t the<br \/>\ndistrict hospital.\n<\/p>\n<p>7.   On\t July  27,  1993,  she\twas  produced  before\tIInd<br \/>\nA.C.J.M., Bareilly for recording her statement under Section<br \/>\n164  CrPC.   Her  statement  was  not  recorded\t since\t the<br \/>\nsituation   outside   the  court  was  tense.\t There\t was<br \/>\napprehension  of breach of peace.  The\tMagistrate  directed<br \/>\nthat  she  be  produced\t on  July  30,\t1993.\tUnder  these<br \/>\ncircumstances, she was sent to Nari Niketan, Bareilly.\n<\/p>\n<p>8.   On\t July 30, 1993, after perusal of  preliminary  X-ray<br \/>\nreport,\t the Magistrate ordered the release of four  accused<br \/>\npersons\t namely lqbal Singh, Amarjeet Singh, Rajender  Singh<br \/>\nand  Charanjit\talias Channi on\t their\tfurnishing  personal<br \/>\nbonds.\tThey were accordingly, released on the same day.\n<\/p>\n<p>9.   The  arrest of these persons had to be made  because  a<br \/>\ncognizable offence was alleged.\n<\/p>\n<p><span class=\"hidden_text\">502<\/span><\/p>\n<p>10.  In\t view  of  above, it is denied that  there  was\t any<br \/>\nillegal\t detention  of\tanyone.\t Mrs  Nidhi  was  taken\t for<br \/>\nradiological   examination  promptly.\tThe  allegation\t  of<br \/>\nalleged\t detention  and\t harassment are\t totally  false\t and<br \/>\ndenied.\n<\/p>\n<p>11.  A\trejoinder  has\tbeen filed by Mrs  Nidhi  who  would<br \/>\ndescribe  as  to  how she and her husband  were\t taken\tinto<br \/>\ncustody and were taken to Hotel Prayag.\t While in the police<br \/>\nstation,  she was threatened by Sub-Inspector  Narinder\t Pal<br \/>\nSingh and SHO J.C. Upadhyaya and SSI Sukhpal Singh.  She was<br \/>\ndirected  to  implicate her husband and his  family  to\t the<br \/>\neffect\t that\tshe  was  abducted  and\t  forcibly   married<br \/>\nthereafter.   She  was\tmade to sleep on the  floor  in\t the<br \/>\noffice\tof Station House Officer, Police Station Prem  Nagar<br \/>\nall  by\t herself.   However, she was allowed  to  have\tfood<br \/>\nbrought\t by her mother.\t She further states that before\t she<br \/>\nwas  taken  to hospital, Sub-Inspector Narinder\t Pal  Singh,<br \/>\nStation House Officer J.C. Upadhyaya and SSI Sukhpal  Singh,<br \/>\nturn  by  turn\tabused\tand  jostled  her  around  the\troom<br \/>\nthreatening to cause her injuries if she did not write\tdown<br \/>\nthe note they wished to dictate.  SSI Sukhpal Singh went  to<br \/>\nthe extent of using his &#8216;danda&#8217; on her legs and poking it in<br \/>\nher  stomach.\tThis  harassment continued  inspite  of\t her<br \/>\ntelling\t them  that  she had married of her  own  free\twill<br \/>\nDuring her stay in the police station, a lady constable\t was<br \/>\ndeputed to guard her.\n<\/p>\n<p>12.  On\t the  morning of July 26, 1993,\t SSI  Sukhpal  Singh<br \/>\nalong with Station House Officer J.C. Upadhyaya began  using<br \/>\nfoul  language and making threatening gestures\tintimidating<br \/>\nher  to write a dictated note.\tOnly when SSI Sukhpal  Singh<br \/>\nonce  again  hit  her  with a danda on\ther  legs  and\tmade<br \/>\nthreatening  gestures  aiming his danda at  her\t head,\tupon<br \/>\nwhich  she  became  petrified  and wrote  in  her  own\thand<br \/>\nwhatever  was  dictated to her by  J.C.\t Upadhyaya,  Station<br \/>\nHouse  Officer,\t P.S.  Prem Nagar.   Likewise,\tshe  alleges<br \/>\nharassment  throughout\ther  stay in  police  station.\t She<br \/>\nfurther\t alleges that J.C. Upadhyaya, Station House  Officer<br \/>\nthreatened her that even if the marriage was declared  valid<br \/>\nby court, he would make her life miserable.\n<\/p>\n<p>13.  Having   regard  to  these\t allegations  and   counter-<br \/>\nallegations,  we think before we arrive at a conclusion,  it<br \/>\nis  highly desirable to call for a report from the  District<br \/>\nJudge, Bareilly who will make a thorough enquiry of all\t the<br \/>\npersons.
