SHARMA, J (ORAL)<\/p>\n<p>CM No. 13797-CII of 2008<\/p>\n<p>          This application under Section 151 of the Code of Civil<\/p>\n<p>Procedure has been moved for revival of C.R. No. 1549 of 2006 decided<\/p>\n<p>on 9.10.2007.\n<\/p>\n<p>          Learned counsel appearing on behalf of the applicant-<\/p>\n<p>petitioner states, that the counter claim raised by the petitioner for mesne<\/p>\n<p>profit by way of damages and use and occupation was still pending<\/p>\n<p>adjudication and had not been withdrawn, therefore, the statement made<br \/>\n Civil Revision No. 1549 of 2006<br \/>\n<span class=\"hidden_text\">                                                                      -2-<\/span><\/p>\n<p>by respondent No. 1 was not correct. Revision petition had not become<\/p>\n<p>infructuous, as stated.\n<\/p>\n<p>           On consideration, and in view of the averments made in the<\/p>\n<p>application, C.M. is allowed, order dated 9.10.2007 is recalled and the<\/p>\n<p>case is restored to its original number.\n<\/p>\n<p>CR No. 1549 of 2006<\/p>\n<p>           This revision petition is directed against the order dated<\/p>\n<p>20.2.2006 passed by the learned Civil Judge (Junior Division),<\/p>\n<p>Chandigarh, on an application moved by the petitioner herein, seeking<\/p>\n<p>direction to the respondent\/plaintiff to pay a sum of Rs.30,000\/- per<\/p>\n<p>month as mesne profit during the pendency of the counter claim.<\/p>\n<p>           The respondent\/plaintiff filed a suit for specific performance<\/p>\n<p>of agreement to sell claiming therein, that 50% of the sale consideration<\/p>\n<p>was paid to the owners of the property in dispute.                   The<\/p>\n<p>respondent\/plaintiff, therefore, sought specific performance of agreement<\/p>\n<p>to sell.\n<\/p>\n<p>           The suit is being contested by the defendants.<\/p>\n<p>           However, the petitioner filed a counter claim seeking<\/p>\n<p>possession of the property in dispute, and claimed mesne profit for use<\/p>\n<p>and occupation.\n<\/p>\n<p>           During the pendency of the suit, application under Section 151<\/p>\n<p>of the Code of Civil Procedure was moved for payment of Rs.30,000\/-<\/p>\n<p>per month as mesne profit.\n<\/p>\n<p>           The learned trial Court, on consideration of the respective<\/p>\n<p>contentions of the parties, was pleased to dismiss the application by<\/p>\n<p>holding, that the rights of the parties were yet to be determined,<br \/>\n Civil Revision No. 1549 of 2006<br \/>\n<span class=\"hidden_text\">                                                                          -3-<\/span><\/p>\n<p>therefore, at this stage the application moved for grant of mesne profit @<\/p>\n<p>Rs.30,000\/- per month was totally mis-conceived.<\/p>\n<p>          Learned counsel for the petitioner contends, that under the<\/p>\n<p>principle of equity, the petitioner, being owner of the 1\/4th share, was<\/p>\n<p>entitled to mesne profit for use and occupation at least qua her share.<\/p>\n<p>          This contention of the learned counsel for the petitioner cannot<\/p>\n<p>be accepted. The respondent\/plaintiff has denied that any amount is<\/p>\n<p>payable. The stand of the plaintiff is that he is holding the property<\/p>\n<p>under the part performance of the agreement to sell and, therefore, is not<\/p>\n<p>liable to pay any rent to the petitioner nor any damages for use and<\/p>\n<p>occupation are payable.\n<\/p>\n<p>          The learned trial Court, in facts and circumstances was right in<\/p>\n<p>dismissing the application, by holding that the dispute between the<\/p>\n<p>parties was yet to be determined. Therefore, by way of interim relief, the<\/p>\n<p>application filed could not be entertained.<\/p>\n<p>          The order being in consonance with the law, does not call for<\/p>\n<p>any interference by this Court in exercise of revisional jurisdiction under<\/p>\n<p>Article 227 of the Constitution of India.<\/p>\n<p>          No merit.\n<\/p>\n<p>          Dismissed.\n<\/p>\n<p>                                                   (Vinod K.
