No. 2972 of 2008\n            -------------------------------------------------\n         Dated this the 13th day of August, 2008\n\n                               ORDER\n<\/pre>\n<p>     In   pursuance      of   the    order     dated     11\/7\/2008  in<\/p>\n<p>Crl.M.C.No.2408\/08, the learned Magistrate has passed the<\/p>\n<p>impugned order under which the petitioner was directed to<\/p>\n<p>furnish bank guarantee of Rs.10 lakhs.           The learned counsel<\/p>\n<p>for the petitioner submits that the amount fixed by the learned<\/p>\n<p>Magistrate is grossly excessive and that the value of the two<\/p>\n<p>vehicles put together will not exceed Rs.6 lakhs.<\/p>\n<p>     2.   The    learned      Public     Prosecutor,      after taking<\/p>\n<p>instructions, submits that in the assessment of the prosecution<\/p>\n<p>on the basis of the valuation made by the Assistant Motor<\/p>\n<p>Vehicle Inspector, the total value of the two vehicles would<\/p>\n<p>exceed Rs.11 lakhs.\n<\/p>\n<p>     3.   The learned counsel for the petitioner, in these<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No. 2972 of 2008 -: 2 :-<\/span><\/p>\n<p>circumstances, prays that a further opportunity may be given to<\/p>\n<p>the petitioner to satisfy the learned Magistrate by securing a<\/p>\n<p>report from the Mechanical Engineer attached to the Excise<\/p>\n<p>Department that the actual value of the two vehicles put<\/p>\n<p>together will not exceed Rs.6 lakhs.\n<\/p>\n<p>     4.    I am satisfied, in these circumstances, that the<\/p>\n<p>impugned order can be set aside and the petitioner can be given<\/p>\n<p>an opportunity to place before court all relevant materials in<\/p>\n<p>support of his contention that the value of the two vehicles put<\/p>\n<p>together will not exceed Rs.6 lakhs.    After conducting enquiry<\/p>\n<p>pointedly into this aspect, the learned Magistrate can fix<\/p>\n<p>appropriate amount as value of the vehicles.<\/p>\n<p>     5.
