                             The   petitioner   is   aggrieved   by   her<\/p>\n
                 termination from the post of Aganwari Sewika by order<\/p>\n
                 dated 6.5.2008 of the District Magistrate as affirmed in<\/p>\n
                 appeal on 7.11.2009 by the Commissioner, Patna<\/p>\n
                 Division.\n<\/p>\n
                             The short submission is that the removal<\/p>\n
                 was in violation of the principles of natural justice<\/p>\n
                 without a show cause notice.\n<\/p>\n
                             Counsel for the State submits that during<\/p>\n
                 inspection the petitioner was found absent.<\/p>\n
                             The issue raised stands fully covered by a<\/p>\n
                 Division Bench judgment of this Court reported in
\n                              2<\/span><\/p>\n
           2004(2) PLJR 833 (DB) that such removal was not<\/p>\n
           permissible in violation of natural justice.<\/p>\n
                       The impugned orders dated 7.11.2009 and<\/p>\n
           16.6.2008 are not sustainable.     They are accordingly<\/p>\n
           set aside but without prejudice to the rights of the<\/p>\n
           respondents to proceed afresh in accordance with law.<\/p>\n
                        The application stands allowed.\n<\/p>\n<\/p>\n
