No.35617 of 2008\n    Jay Krishna Yadav, Son of late Tarni Yadav, Resident of village Gobergarha Kanp, PS Sour\n                             Bazar, District Saharsa ----- Petitioner\n                                             Versus\n                                State Of Bihar ----- Opposite Party\n                                            -----------\n<\/pre>\n<p>2        14.7.2011                      Heard learned counsel for the petitioner and the<\/p>\n<p>                            counsel appearing on behalf of the State.\n<\/p>\n<p>                                        The petitioner is aggrieved by the order dated<\/p>\n<p>                            13.5.2008 taking cognizance for the offences under Sections 341,<\/p>\n<p>                            323, 452 and 304 of the Indian Penal Code.\n<\/p>\n<p>                                        Learned counsel for the petitioner submits that while<\/p>\n<p>                            supervising the case, the Officer concerned found that no offence<\/p>\n<p>                            is made out under Section 452 of the Indian Penal Code, yet the<\/p>\n<p>                            Judicial Magistrate, Saharsa has taken cognizance under Section<\/p>\n<p>                            452 of the Indian Penal Code.\n<\/p>\n<p>                                        These issues may be raised at the appropriate stage of<\/p>\n<p>                            the case.
