No.2200 of 2009\n            ----------------------------------------------\n                 Dated 16th October, 2009.\n\n                        J U D G M E N T\n<\/pre>\n<p>Kurian Joseph, J.\n<\/p>\n<p>     C.M.Appln.1034\/2009: Heard. Delay condoned.<\/p>\n<p>     This appeal is filed by the State aggrieved by the<\/p>\n<p>judgment of the learned Single Judge regarding fixation of<\/p>\n<p>wages of Part Time Sweepers. It is not in dispute that the<\/p>\n<p>Part Time Sweeper involved in this case is engaged for the<\/p>\n<p>sweeping and cleaning works in the Krishi Bhavan, Adoor.<\/p>\n<p>The strenuous contention of the learned Government Pleader<\/p>\n<p>is that the sweeping area is, as a matter of fact, below 100<\/p>\n<p>square meters. But we do not think that in the facts of this<\/p>\n<p>case, particularly in view of the binding judgment(Ext.P1),<\/p>\n<p>wherein there is a declaration that the area to be swept is<\/p>\n<p>above 100 meters, these contentions need be gone into. It is<\/p>\n<p>true, as rightly pointed out by the Government Pleader that<\/p>\n<p>the measurement is prior to the issuance of the Government<\/p>\n<p>Order, G.O.(P)No.501\/05 dated 25.11.2005. But as already<\/p>\n<p>noted by us above, for sweeping the entire Krishi Bhavan<\/p>\n<p>office, there is only one Part Time Sweeper, though she is<\/p>\n<p>otherwise designated as casual.           We find that all these<\/p>\n<p>W.A.No.2200\/2009<br \/>\n<span class=\"hidden_text\">                            -: 2 :-<\/span><\/p>\n<p>contentions have been taken by the State before this court in<\/p>\n<p>W.A.2828\/07 and being aggrieved, the matter was pursued<\/p>\n<p>before the Supreme Court and the Supreme Court also<\/p>\n<p>dismissed Civil Appeal No.15693\/08         by order dated<\/p>\n<p>23.2.2009. Therefore, it is not necessary for this court to go<\/p>\n<p>into the merits of the case.
