No.42852 of 2009\n                      JIWRATAN YADAV @ JEORATAN YADAV\n                                   Versus\n                               STATE OF BIHAR\n                                -----------\n<\/pre>\n<p>8.   24\/11\/2010           Perused the office note dated 19.11.2010.<\/p>\n<p>                  Office has placed a letter of the S.P., Bhojpur<\/p>\n<p>                  at    Ara,   contained        in   Memo     No.157\/LC      dated<\/p>\n<p>                  15.11.2010,         addressed       to      the     Assistant<\/p>\n<p>                  Registrar of the High Court, in which he has<\/p>\n<p>                  claimed that the order dated 19.5.2010 passed<\/p>\n<p>                  in    this   case     and   communicated       to    him     vide<\/p>\n<p>                  Court&#8217;s letter no.14967 dated 17.6.2010, &#8216;does<\/p>\n<p>                  not     appear   to    have     been     received&#8217;      in    his<\/p>\n<p>                  office. Therefore, he has asked for a copy of<\/p>\n<p>                  the said order. Office points out that a copy<\/p>\n<p>                  of the said order had been faxed to him.<\/p>\n<p>                          This Court by order dated 19.5.2010 had<\/p>\n<p>                  asked the S.P., Bhojpur at Ara to submit a<\/p>\n<p>                  report as to why, inspite of issue of non-<\/p>\n<p>                  bailable warrant of arrest by the trial court<\/p>\n<p>                  for production of witnesses, the same was not<\/p>\n<p>                  being    executed     and     witnesses     were    not    being<\/p>\n<p>                  produced.     Since     then,      report    has    not      been<\/p>\n<p>                  submitted. Therefore, by order dated 27.10.2010<\/p>\n<p>                  this Court had directed the S.P., Bhojpur at<\/p>\n<p>                  Ara to appear in person in the Court on 10th<\/p>\n<p>                  November, 2010 and to show cause as to why a<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>           contempt      proceeding            may     not      be        initiated<\/p>\n<p>           against him and he may not be punished for<\/p>\n<p>           disobedience of the orders of this Court.<\/p>\n<p>                   Office reports that this order was faxed<\/p>\n<p>           directly      to        the    S.P.,       Bhojpur        at    Ara     on<\/p>\n<p>           8.11.2010.\n<\/p>\n<p>                   Inspite of the said order, S.P., Bhojpur<\/p>\n<p>           at Ara has not appeared in Court in this case.<\/p>\n<p>           The communication of the S.P., Bhojpur at Ara<\/p>\n<p>           kept at Flag-R does not mention that this order<\/p>\n<p>           was also not received by him. It is apparent<\/p>\n<p>           that the S.P., Bhojpur at Ara is taking up the<\/p>\n<p>           matter    too      casually         and    has     not     shown       any<\/p>\n<p>           concern       to        comply      with     the     order           dated<\/p>\n<p>           27.10.2010         which       he   does    not     deny        to    have<\/p>\n<p>           received.\n<\/p>\n<p>                   Let    a    bailable         warrant       of      arrest       be<\/p>\n<p>           issued against S.P., Bhojpur at Ara to ensure<\/p>\n<p>           his appearance in this case on 8th December,<\/p>\n<p>           2010.      The          bailable          warrant         shall         be<\/p>\n<p>           communicated        to        the   office    of     the       Director<\/p>\n<p>           General of Police, who shall be responsible for<\/p>\n<p>           its execution.\n<\/p>\n<p>                   List this case on 8th December, 2010 as a<\/p>\n<p>           first case.\n<\/p>\n<\/p>\n<pre>Pradeep\/                              ( J.
