Senior Civil Judge,<br \/>\nSabarkantha -? Himmatnagar in Land Reference Cases No. 2 of 1997 to<br \/>\n7 of 1997 whereby, the said references were partly allowed.\n<\/p>\n<p>2.0\t\tThe<br \/>\nfacts in brief leading rise to the filing of the present appeals are<br \/>\nas under;\n<\/p>\n<p>2.1\t\tThe<br \/>\nrespondent ?  authority proposed to acquire the agricultural lands,<br \/>\nbelonging to the appellants ?  claimants, under the provisions of<br \/>\nthe Land Acquisition Act, 1894 for the purpose of constructing a<br \/>\nPond. Notification u\/s. 4 and thereafter, u\/s. 6 of the said Act were<br \/>\nissued. After completion of all the legal formalities, the competent<br \/>\nauthority of the respondent ?  State, by award dated 31.03.1994,<br \/>\ngranted compensation @ Rs.60\/- per Are for irrigated land, Rs.40\/-<br \/>\nper Are for non-irrigated land and Rs.1\/- per Are for kharaba<br \/>\nland.\n<\/p>\n<p>2.2\t\tBeing<br \/>\naggrieved by the said amount of compensation awarded by the<br \/>\nrespondent ?  authority, the claimants preferred applications before<br \/>\nthe respondent ?  authority requesting to refer the cases to the<br \/>\ncompetent Court, by way of references, which, ultimately, came to be<br \/>\nnumbered as Land Reference Cases No. 2\/1979 to 7\/1979.\n<\/p>\n<p>2.3\t\tThe<br \/>\nreference Court, after hearing the parties and after considering the<br \/>\nevidence on record, partly allowed the references whereby, the<br \/>\nreference Court awarded Rs.300\/- per Are for irrigated land, Rs.250\/-<br \/>\nper Are for non-irrigated land and Rs.5\/- per Are for kharaba<br \/>\nland. The reference Court also<br \/>\ndirected the authority to pay interest @ 9% p.a. from the date of<br \/>\naward of the Land Acquisition Officer till its realization.\n<\/p>\n<p>3.0<br \/>\nHeard learned counsel for the respective parties. The appellants ?<br \/>\nclaimants have challenged the judgment and award of the reference<br \/>\nCourt only qua the direction issued in Paragraph No. 5 of the<br \/>\noperative part of the impugned award whereby, the reference Court has<br \/>\ndirected to pay interest on the<br \/>\nexcess amount @ 9% per annum from the date of award of the Collector<br \/>\ntill its realization.\n<\/p>\n<p>4.0\t\tIt is contented on<br \/>\nbehalf of the claimants that in view of the provision of Section 28<br \/>\nof the said Act, the reference Court ought to have granted interest<br \/>\non the excess amount @ 9% per annum from the date of taking over of<br \/>\nthe possession of the lands in question to the date of payment of<br \/>\nsuch excess into the Court.\n<\/p>\n<p>5.0\t\tHaving gone through the<br \/>\nimpugned award, I am of the view that the said contention raised by<br \/>\nthe claimants requires consideration inasmuch as Section 28 of the<br \/>\nsaid Act mandates that interest on the excess amount has to be paid @<br \/>\n9% per annum from the date on which the possession of the lands was<br \/>\ntaken over by the Collector to the date of payment of the said amount<br \/>\ninto the Court. The learned AGP is not in a position to dispute this<br \/>\nproposition of law.\n<\/p>\n<p>6.0\t\tIn the present case,<br \/>\nthe reference Court has granted interest on the excess amount from<br \/>\nthe date of award of the Collector to till its realization, which is,<br \/>\nessentially, contrary to the provisions of Section 28 of the said<br \/>\nAct. Hence, the said direction issued in the impugned award is<br \/>\nrequired to be modified accordingly.\n<\/p>\n<p>7.0\t\tIn the aforesaid<br \/>\npremises, the Appeals are partly allowed. The impugned judgment and<br \/>\naward of the reference Court is modified to the extent that the<br \/>\nappellants ?  claimants will be entitled for interest on the excess<br \/>\namount @ 9% per annum from  12.04.1988, i.e. when the<br \/>\npossession of the lands was taken by the authority, to the date of<br \/>\npayment of the excess amount into the Court. The rest part of the<br \/>\nimpugned judgment and award stands confirmed on the same terms. The<br \/>\nappeals stand disposed of accordingly.  No order as to costs.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
