ORAL JUDGEMENT
\n     By means of filing this petition, the petitioner
\n     has challenged the order of detention dated 20-4-2002
\n passed by the Police Commissioner, Ahmedabad City who has
\nbeen declared as a dangerous person.\n<\/p>\n
2.It is a settled principle of law that in order to
\nbring a person within the expression “dangerous person”
\nas defined in clause (c) of section 2 of the Gujarat
\nPrevention of Anti-Social Activities Act, 1985 (for short
\n`the Act of 1985′), there should be positive materials to
\nindicate that such person is habitual of committing or
\nattempting to commit or abetting the commission of
\noffences which are punishable under Chapter XVI or XVII
\nof Chapter V of the Arms Act and that single or isolated
\nact   falling   under   the   said   Chapters cannot be
\ncharacterised as a habitual acts as envisaged in section
\n2(c) of the PASA Act. Further, besides a person being a
\ndangerous person, her activities should also fall within
\nthe ambit of expression `public order’. A distinction
\nhas to be drawn between the `law and order’           and
\n`maintenance of public order’. A reference may be made
\nof M.J.Shaikh V. M.M. Mehta, Commissioner of Police &
\nOrs.,<\/a> reported in 1995 (2) GLR 1268.\n<\/p>\n
3.I have heard learned advocate for the petitioner
\nat length and also perused the material on record. But
\nlearned advocate for the petitioner has restricted his
\nargument on the point that representation has been made
\nby brother of the petitioner on 20-5-2002 and same has
\nnot been decided by the authority till 3-6-2002 and,
\ntherefore, there is a delay.\n<\/p>\n
4.In the instant case, it appears that though
\nrepresentation has been sent on 20-5-2002, it remained
\nundecided till 3-6-2002. So, there is a delay. The Apex
\nCourt relying upon a decision of the Constitutional Bench
\nin K.M.Abdulla Kunhi and B.L.Abdul Khader V.    Union of
\nIndia, (1991) 1 SCC 476 : (1991 AIRSCW 362), has held in
\na case of Rajammal Vs. State of Tamil Nadu and another
\nreported in AIR 1999 S.C. 684 as under:\n<\/p>\n
 “Detention-Unexplained delay of five days in
\n        considering      and       disposing      detenu’s
\n        representation-Mere absence     of   Minister   at
\n        Headquarters    not    sufficient     to   justify
\n        delay-Detention vitiated.”\n<\/p>\n
  It has been further held by the Apex Court in para 9 as
\n  under:\n<\/p>\n
 “The position, therefore, now is that if delay
\n        was caused on account of any indifference or
\n        lapse in considering the representation such
\n         delay will adversely affect further detention of
\n        the prisoner. In other words, it is for the
\n        authority concerned to explain the delay, if any,
\n        in disposing the representation.It is not enough
\n        to say that the delay was very short.        Even
\n        longer delay can as well be explained. so the
\n        test is not the duration or range of delay, but
\n        how it is explained by the authority concerned.”\n<\/p>\n
5.In   the matter before the Supreme Court in
\nRajammal (supra), it appeared that there was a delay of
\nfive days.      For   that also, explanation has been
\nputforward by the authority that Minister was on tour for
\na period of two days. Still, Apex Court has stated that
\nfive days consumed in deciding the representation of the
\ndetenu is a delay.      Whereas in the present      case,
\nrepresentation has been made by the brother of the detenu
\non 20-5-2002 which has not been decided till 3-6-2002.
\nHence, there is a delay of approximately fourteen days in
\nconsidering the representation. It is to be noted that
\nin this case no satisfactory explanation has been put
\nforward by the respondents. As representation has not
\nbeen decided by the authority in time, the rights
\nguaranteed under Article 22(5) of the Constitution of
\nIndia are violated which make the order of detention
\nillegal.\n<\/p>\n
6.The petition is allowed. The impugned order of
\ndetention dated 20-4-2002 passed against the detenu
\nMangalsing Vikramsing Thakur is hereby quashed and set
\naside. The detenu is ordered to be set at liberty
\nforthwith, if not required in any other case. Rule is
\nmade absolute accordingly with no order as to costs.
\nDirect service is permitted.\n<\/p>\n
