The Union of India\n                                             -----------\n<\/pre>\n<p>4.   12.10.2011               Heard learned Counsel for the petitioner and the<\/p>\n<p>                  Union of India.\n<\/p>\n<p>                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Section 414 of the Indian Penal Code and<\/p>\n<p>                  Sections 17 and 25 of the Narcotic Drugs and Psychotropic<\/p>\n<p>                  Substances Act.\n<\/p>\n<p>                             The prosecution case is that on a tip off the police<\/p>\n<p>                  intercepted a sumo vehicle and two motorcycles in a<\/p>\n<p>                  suspicious condition. From the sumo vehicle 5kgs of alleged<\/p>\n<p>                  brown sugar was recovered. It is not specified in the First<\/p>\n<p>                  Information Report as to who was the occupant of the sumo<\/p>\n<p>                  vehicle nor as to which of the accused persons was sitting on<\/p>\n<p>                  the motorcycle. During investigation the petitioner raised a<\/p>\n<p>                  plea that he was going to Patna to buy medicines of his grand<\/p>\n<p>                  father, which fact was supported even by the truck driver, who<\/p>\n<p>                  had given lift up to some distance.\n<\/p>\n<p>                            Considering the aforesaid fact as also that no<\/p>\n<p>                  material was recovered from the conscious possession of the<\/p>\n<p>                  petitioner, who has fair antecedents, let the petitioner above<\/p>\n<p>                  named, be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                  5,000\/-(Five thousand) with two sureties of the like amount<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>            each or any other surety to be fixed by the court concerned to<\/p>\n<p>            the satisfaction of learned Additional Sessions Judge 3rd,<\/p>\n<p>            Jehanabad in connection with Makhdumpur P.S. Case No.<\/p>\n<p>            163 of 2011, subject to the conditions (i) That one of the bailor<\/p>\n<p>            shall be the father of the petitioner and the other bailor shall<\/p>\n<p>            be local since the petitioner belongs to Gaya district. The<\/p>\n<p>            bailors will undertake to furnish information to the Court about<\/p>\n<p>            any change in address of the petitioner. (ii) That the affidavit<\/p>\n<p>            shall clearly state that the petitioner is not an accused in any<\/p>\n<p>            other case and if he is he shall not be released on bail, (iii)<\/p>\n<p>            That the bailor shall also state on affidavit that he will inform<\/p>\n<p>            the court concerned if the petitioner is implicated in any other<\/p>\n<p>            case of similar nature after his release in the present case and<\/p>\n<p>            thereafter the court below will be at liberty to initiate the<\/p>\n<p>            proceeding for cancellation of bail on ground of misuse, (iv)<\/p>\n<p>            That the petitioner will give an undertaking that he will receive<\/p>\n<p>            the police papers on the given date and be present on date<\/p>\n<p>            fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>            delays the trial in any manner, his bail will be liable to be<\/p>\n<p>            cancelled for reasons of misuse, (v) That the petitioner will be<\/p>\n<p>            well represented on each date if he fails to do so on two<\/p>\n<p>            consecutive dates, his bail will be liable to be cancelled.<\/p>\n<pre>Narendra\/                       ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Pankaj Kumar vs The State Of Bihar on 12 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
