Relying on the grounds raised in the petition, he,<br \/>\nfurther, submitted that, though, in the impugned order it is recorded<br \/>\nthat the representatives of the petitioner No.1 were heard by the<br \/>\ncompetent authority on 07.01.2010, as a matter of fact, no such<br \/>\nhearing took place on 07.01.2010. It is submitted that there was no<br \/>\ncommunication from the authorities to the petitioners that the<br \/>\nhearing will take place on 07.01.2010, and therefore, representatives<br \/>\nof the petitioner No.1 were not present, on the said date.\n<\/p>\n<p>3.\t\tThese<br \/>\nfactual aspects and averments are not denied by the respondent.\n<\/p>\n<p>4.\t\tUnder<br \/>\nthe circumstances, I am of the opinion that the proceedings are<br \/>\nrequired to be remanded for fresh consideration and decision, in<br \/>\naccordance with law, by the authorities.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result, impugned order dated 18.11.2010 is QUASHED.<br \/>\nThe matter is REMANDED to<br \/>\nthe respondent authorities for fresh consideration and decision. The<br \/>\npetitioners shall be SUPPLIED all the documents, upon<br \/>\nwhich the authorities seek to place RELIANCE. This may<br \/>\nbe done within THREE WEEKS, from today.  The date of<br \/>\nhearing before the said authorities, at the first stage, shall be<br \/>\n17TH JANUARY, 2011.\n<\/p>\n<p> On that day, if it is not convenient to conduct the hearing to the<br \/>\nsaid authorities, the same may be fixed for some other date, after<br \/>\nCOMMUNICATING the representatives of the petitioner<br \/>\nNo.1-Company.
