Kodekar, learned APP waives service of rule on behalf of the<br \/>\nrespondent State.\n<\/p>\n<p>2.\t\tThis<br \/>\napplication is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with complaint being C.R. No. I-87 of 2008<br \/>\nregistered with Mahuva Police Station, Bhavnagar for the offences<br \/>\npunishable under Sections 366, 380 read with 114 of  the Indian Penal<br \/>\nCode.\n<\/p>\n<p>3.\t\tIn<br \/>\nthe event of the arrest of the petitioner in connection with C.R. No.<br \/>\nI-87 of 2008 registered with Mahuva  Police Station, Bhavnagar, he<br \/>\nshall be released on anticipatory bail in respect of the offences<br \/>\nalleged against him in this application on his executing a bond of<br \/>\nRs. 5000\/- (Rupees five thousand only) with one surety of the like<br \/>\namount, by the concerned police officer and on conditions that he<br \/>\nshall:\n<\/p>\n<p>(a)\tremain<br \/>\npresent before the trial Court regularly as and when directed on the<br \/>\ndates fixed;\n<\/p>\n<p>(b)\tremain<br \/>\npresent at the concerned police station on 23.6.2008 any time between<br \/>\n9.00 a.m and 3.00 p.m.;\n<\/p>\n<p>(c<br \/>\n)\tmake himself available for interrogation by a Police Officer,<br \/>\nwhenever and wherever required;\n<\/p>\n<p>(d)\tnot<br \/>\ndirectly or indirectly make any inducement, threat or promise to any<br \/>\nperson acquainted with the facts of the case so as to dissuade him<br \/>\nfrom disclosing such facts to the Court or to any Police Officer;\n<\/p>\n<p>(e)\tnot<br \/>\nto obstruct or hamper the police investigation and not to play<br \/>\nmischief with the evidence collected or yet to be collected by the<br \/>\npolice;\n<\/p>\n<p>(f)\tat<br \/>\nthe time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nhis residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>(g)\tnot<br \/>\nleave India without the permission of the Court and if having<br \/>\npassport, shall deposit the same before the trial Court within a<br \/>\nweek.\n<\/p>\n<p>4.\t\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand if he considers it proper and just; and the competent Court<br \/>\nwould decide it on merits.\n<\/p>\n<p>5.\t\tThis<br \/>\norder will hold good, if the applicant is arrested at any time within<br \/>\n90 days from today. The order for release on bail will remain<br \/>\noperative only for a period of ten days from the date of his arrest.<br \/>\nThereafter, it will be open to the petitioner to make a fresh<br \/>\napplication for being enlarged on bail in usual course which when it<br \/>\ncomes before the competent Court, will be disposed of in accordance<br \/>\nwith law, having regard to all the attending circumstances and the<br \/>\nmaterials available at the relevant time uninfluenced by the fact<br \/>\nthat anticipatory bail was granted.\n<\/p>\n<p>\t\tRule<br \/>\nis made absolute.
