On account of the re-organization of the Department<br \/>\nw.e.f. 01.04.1971, the post of Mining Clerk was designated as Senior<br \/>\nClerk and their pay-scale was fixed at Rs.200   340. On 22.10.1973<br \/>\nan order came to be passed by which the petitioner was transferred as<br \/>\nMines Supervisor w.e.f. 01.11.1973 in the pay-scale of Rs.380<br \/>\n560, which was, subsequently, revised to Rs.1320   2040.\n<\/p>\n<p>3.\tIn<br \/>\n1982 the State Government issued a Circular by which it was clarified<br \/>\nthat those persons who were transferred as Mines Supervisor, in<br \/>\npursuance of the order dated 22.10.1973, were, in fact, transferred<br \/>\non account of promotion and that it was not a mere transfer. As a<br \/>\nresult thereof, the petitioner was given the promotional post of<br \/>\nMines Supervisor in the scale of Rs.380   560 w.e.f. 01.11.1973.\n<\/p>\n<p>4.\tIt<br \/>\nis the case of the petitioner that the pay-scale of the post of Mines<br \/>\nSupervisor has not been properly fixed inasmuch as an employee who is<br \/>\nserving on the post of Senior Clerk, which is junior in cadre in<br \/>\ncomparison to that of a Mines Supervisor, would receive a much higher<br \/>\nscale of pay over a period of time if such employee does not opt for<br \/>\npromotion to the next post. On account of the aforesaid disparity,<br \/>\nthe petitioner has been receiving a much lesser in spite of getting<br \/>\npromotion. The petitioner made representations to the<br \/>\nrespondent-authorities requesting to rectify the aforesaid anomaly in<br \/>\npursuance of an order passed by this Court in an earlier round of<br \/>\nlitigation. However, no action was taken. Hence, this petition.\n<\/p>\n<p>5.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. The petitioner was promoted to the post of Mines<br \/>\nSupervisor from the post of Senior Clerk in the pay-scale of Rs.200<br \/>\n340 on 22.10.1973. As per the G.C.S.R. Rules of 1975, which came into<br \/>\neffect on 01.01.1973, the pay-scale of Senior Clerk was fixed at<br \/>\nRs.330   560 and that of Mines Supervisor at 380   560.<br \/>\nAccordingly, the pay-scale of the petitioner was fixed at Rs.380<br \/>\n560 w.e.f. 01.11.1973.\n<\/p>\n<p>6.\tFrom<br \/>\nthe affidavit-in-reply filed on behalf of the respondent, it<br \/>\ntranspires that promotion to the post of Mines Supervisor is governed<br \/>\nby the B.C.S.R. Rules. Those employees who get promotion to the post<br \/>\nof Mines Supervisor from the post of Senior Clerk are not entitled<br \/>\nfor select grade available to Senior Clerks. The said structure of<br \/>\npay-scales has been fixed by the Pay Commission set up by the State<br \/>\nGovernment. It is a settled law that in matters pertaining to policy<br \/>\ndecisions, this Court should not substitute its own opinion. Hence, I<br \/>\nfind no merits in the present petition.\n<\/p>\n<p>7.\tFor<br \/>\nthe foregoing reasons, the petition is dismissed.
