{"id":21903,"date":"2006-03-22T00:00:00","date_gmt":"2006-03-21T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/m-abdukwahith-vs-the-general-manager-on-22-march-2006"},"modified":"2015-11-27T19:24:54","modified_gmt":"2015-11-27T13:54:54","slug":"m-abdukwahith-vs-the-general-manager-on-22-march-2006","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/m-abdukwahith-vs-the-general-manager-on-22-march-2006","title":{"rendered":"M.Abdukwahith vs The General Manager on 22 March, 2006"},"content":{"rendered":"<div class=\"docsource_main\">Madras High Court<\/div>\n<div class=\"doc_title\">M.Abdukwahith vs The General Manager on 22 March, 2006<\/div>\n<pre>       \n\n  \n\n  \n\n \n \n BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT\n\n\nDATED: 22\/03\/2006\n\n\nCORAM:\nTHE HONOURABLE MR.JUSTICE P.JYOTHIMANI\n\n\nW.P.No.80 of 2006\nand\nW.P.M.P.No.71 of 2006\n\n\nM.Abdukwahith\t\t\t\t... \tPetitioner\n\n\nVs.\n\n\nThe General Manager\nTamil Nadu State Transport Corpn.,\nMadurai division-IV,\nDindigul.\t\t\t\t... \tRespondent\n\n\t\nPRAYER\n\n\nWrit Petition filed under Article 226 of the Constitution of India\npraying for the issuance of a Writ of  Mandamus, call for the records relating\nto the impugned order passed by the respondent in his proceedings No.    2171\ndated 03.09.2002 and quash the same and illegal and consequently direct the\nrespondent to reinstate the petitioner in service.\n\n\n!For Petitioner   \t...\tMr.M.Ajmal Khan\n\t\n\n^For Respondent      \t...\tMr.K.Mahendran\n\t\t\t\tSpecial Government Pleader\n\t\t\t\t\t\n\n:ORDER\n<\/pre>\n<p>\tThis writ petition is filed challenging the order of the first respondent<br \/>\ndated 03.09.2002, under which the respondent has discharged the petitioner of<br \/>\nservice, based on the medical report that the petitioner was not fit to serve as<br \/>\na driver.\n<\/p>\n<p>\t2.I have heard the learned counsel for the petitioner and Mr.K.Mahendran,<br \/>\nSpecial Government Pleader, appearing for the respondent.\n<\/p>\n<p>\t3.By consent of both sides, the Writ Petition is taken up for final<br \/>\ndisposal.\n<\/p>\n<p>\t4.In the medical report dated 07.06.2002, it is mentioned as follows:\n<\/p>\n<p>\t&#8220;The Board has examined him and found that he has not recovered from his<br \/>\nillness and certified that he is unfit for driver duty&#8221;.\n<\/p>\n<p>It is based on the medical report that the petitioner was discharged.\n<\/p>\n<p>\t5.According to the learned counsel for the petitioner, even though the<br \/>\npetitioner had some severe paralytic attack, now he has fully recovered from the<br \/>\nsame and he is fit for the work as a driver.\n<\/p>\n<p>\t6.In view of the same, to meet the ends of justice, this Court of the view<br \/>\nthat a direction should be given to the respondent to refer the petitioner to<br \/>\nMedical Board and examine the nature of the disability of the petitioner<br \/>\nsuffered and whether the petitioner is fit to work as a driver or not.\n<\/p>\n<p>\t7.For that course of action, the learned counsel for the respondent has no<br \/>\nobjection. In view of the same this petition is disposed of with the following<br \/>\ndirection:\n<\/p>\n<p>\t&#8220;Respondent is directed to produce the petitioner before the Medical Board<br \/>\nand examine his disability. If according to the Medical Report, the petitioner<br \/>\nis fit as on date for the job of driver, the respondent can pass further orders<br \/>\nappointing the Petitioner as driver immediately in the said post. It is also<br \/>\nmade clear that the petitioner would be entitled for all other benefits for the<br \/>\nservice rendered by him by the respondent corporation.\n<\/p>\n<p>\t8.With the above direction this petition is disposed of.
