Justice K.T.SANKARAN\n\n Dated :03\/11\/2009\n\n O R D E R\n                        K.T.SANKARAN, J.\n                  ---------------------------------------------\n                         B.A.No.5688 of 2009\n                  ---------------------------------------------\n            Dated this the 3rd day of November, 2009\n\n\n                               ORDER\n<\/pre>\n<p>      This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure. The petitioners are<\/p>\n<p>accused Nos.1 and 2 in Crime No.466 of 2009 of Vazhakulam<\/p>\n<p>Police Station, Ernakulam District.<\/p>\n<p>     2.    The offence alleged against the petitioners is under<\/p>\n<p>Section 511 of 380 read with Section 34 of the Indian Penal<\/p>\n<p>Code.\n<\/p>\n<p>     3.    The petitioners are the officers of Kotak Mahindra<\/p>\n<p>Bank Ltd. It is stated that the first petitioner is working as<\/p>\n<p>Deputy Manager (Collection) of Kotak Mahindra Bank Ltd. and<\/p>\n<p>the second petitioner is working as Direct Recovery Agent of the<\/p>\n<p>said Bank. The prosecution case is that on 21.8.2009, the lorry<\/p>\n<p>belonging to the defacto complainant was attempted to be stolen<\/p>\n<p>with the help of accused Nos.4 to 8 who were hired for that<\/p>\n<p>purpose by Kotak Mahindra Bank Ltd. It is also stated that the<\/p>\n<p>intention to repossess was not made known to the police.<\/p>\n<p><span class=\"hidden_text\">BA No.5688\/2009                   2<\/span><\/p>\n<p>      4.    When the Bail Application came up for hearing on 8th<\/p>\n<p>October, 2009, the following order was passed:<\/p>\n<blockquote><p>           &#8220;The learned counsel for the petitioners seeks<\/p>\n<p>           further   time   to   get instructions from the<\/p>\n<p>           petitioners as to whether they are willing to file a<\/p>\n<p>           statement on behalf of Kotak Mahindra Bank Ltd.<\/p>\n<p>           that Kotak Mahindra Bank Ltd. and their officers<\/p>\n<p>           would strictly follow the directions of the<\/p>\n<p>           Supreme Court in <a href=\"\/doc\/819703\/\">ICICI Bank Ltd. vs. Prakash<\/p>\n<p>           Kaur<\/a> (2007(2) SCC 711).\n<\/p><\/blockquote>\n<blockquote><p>                 Post after a week.\n<\/p><\/blockquote>\n<blockquote><p>                 It is submitted by the learned Public<\/p>\n<p>           Prosecutor that the petitioners will not be<\/p>\n<p>           arrested till then.&#8221;<\/p><\/blockquote>\n<p>      5.    An affidavit dated 28th October, 2009 was filed by the<\/p>\n<p>first petitioner.  Though the acts allegedly committed by the<\/p>\n<p>petitioners were attempted to be justified in the affidavit, it is<\/p>\n<p>stated in paragraph 4 of the affidavit thus:<\/p>\n<blockquote><p>                 &#8220;It is further submitted that Kotak Mahindra<\/p>\n<p>            Bank Ltd., Kochi has no intention to repossess the<\/p>\n<p>            vehicle which has due and the owners are failed<\/p>\n<p>            to repay the loan, by any unlawful means. It is<\/p>\n<p>            also clarified and submitted most humbly that any<\/p>\n<p>            repossession of vehicle for which the Bank has<\/p>\n<p>            advanced loan and the owner failed to clear the<\/p>\n<p>            due will be only in accordance with law.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\">BA No.5688\/2009                    3<\/span><\/p>\n<p>      6.
