\/>\naffidavit.\u00a0\n<\/p>\n<p>Steps\u00a0be\u00a0taken\u00a0by\u00a0registered\u00a0post\u00a0within\u00a0ten\u00a0days.\u00a0<\/p>\n<p>Office\u00a0shall\u00a0issue\u00a0notices\u00a0returnable\u00a0at\u00a0an\u00a0early\u00a0date.\u00a0<\/p>\n<p>List \u00a0 for \u00a0 admission \u00a0 immediately \u00a0 after \u00a0 service \u00a0 of \u00a0 notice \u00a0 on \u00a0 the\u00a0<br \/>\nrespondents.\n<\/p>\n<p>The\u00a0petitioner\u00a0no.\u00a01\u00a0claims\u00a0to\u00a0have\u00a0a\u00a0crusher\u00a0unit\u00a0and\u00a0engaged\u00a0in\u00a0the\u00a0<\/p>\n<p>business\u00a0of\u00a0crushing\u00a0stone,\u00a0boulders\u00a0and\u00a0rocks\u00a0into\u00a0grit\u00a0and\u00a0chips\u00a0of\u00a0<\/p>\n<p>different\u00a0sizes.\u00a0For\u00a0the\u00a0purpose\u00a0of\u00a0raw\u00a0materials,\u00a0the\u00a0petitioner\u00a0no.1\u00a0<\/p>\n<p>purchases \u00a0 stone, \u00a0 boulder \u00a0 and \u00a0 rocks \u00a0 from \u00a0 Uttrakhand \u00a0 Forest\u00a0<\/p>\n<p>Development \u00a0 Corporation \u00a0 and \u00a0 forests \u00a0 situated \u00a0 in \u00a0 U.P. \u00a0 and \u00a0 pays\u00a0<\/p>\n<p>transit\u00a0fees.\u00a0\n<\/p>\n<p>\nIt\u00a0is\u00a0contended\u00a0that\u00a0when\u00a0the\u00a0petitioner\u00a0transports\u00a0the\u00a0raw\u00a0materials\u00a0<\/p>\n<p>to\u00a0his\u00a0unit\u00a0situated\u00a0in\u00a0Nazimabad,\u00a0District\u00a0Bijnor\u00a0he\u00a0pays\u00a0the\u00a0transit\u00a0<\/p>\n<p>fees \u00a0 at \u00a0 the \u00a0 check \u00a0 post \u00a0 barrier \u00a0 in \u00a0 the \u00a0 State \u00a0 of \u00a0 U.P. \u00a0 but \u00a0 when \u00a0 the\u00a0<\/p>\n<p>crushed \u00a0 items \u00a0 are \u00a0 transported \u00a0 to \u00a0 other \u00a0 places \u00a0 the \u00a0 officials \u00a0 of \u00a0 the\u00a0<\/p>\n<p>Forest\u00a0Department\u00a0of\u00a0the\u00a0State\u00a0of\u00a0U.P.\u00a0again\u00a0require\u00a0the\u00a0petitioner\u00a0to\u00a0<\/p>\n<p>pay\u00a0the\u00a0transit\u00a0fee\u00a0on\u00a0the\u00a0ground\u00a0that\u00a0he\u00a0is\u00a0transporting\u00a0the\u00a0forest\u00a0<\/p>\n<p>goods \u00a0 as \u00a0 such \u00a0 he \u00a0 is \u00a0 again \u00a0 required \u00a0 to \u00a0 pay \u00a0 transit \u00a0 fee. \u00a0 Learned\u00a0<\/p>\n<p>counsel \u00a0 for \u00a0 the \u00a0 petitioner \u00a0 also \u00a0 submits \u00a0 that \u00a0 the \u00a0 trial \u00a0 court \u00a0 granted\u00a0<\/p>\n<p>temporary\u00a0injunction\u00a0restraining\u00a0the\u00a0respondents\u00a0from\u00a0demanding\u00a0the\u00a0<\/p>\n<p>transit\u00a0fees\u00a0again\u00a0on\u00a0such\u00a0finished\u00a0goods\u00a0where\u00a0the\u00a0transit\u00a0fee\u00a0has\u00a0<\/p>\n<p>already\u00a0been\u00a0paid,\u00a0on\u00a0raw\u00a0material.\u00a0However,\u00a0on\u00a0an\u00a0appeal\u00a0being\u00a0<br \/>\n filed, \u00a0 the \u00a0 lower \u00a0 appellate \u00a0 court \u00a0 has \u00a0 wrongly \u00a0 allowed \u00a0 the \u00a0 same.\u00a0<\/p>\n<p>Learned\u00a0 counsel \u00a0for\u00a0 the\u00a0 petitioners \u00a0relying\u00a0upon\u00a0a\u00a0Division\u00a0Bench\u00a0<\/p>\n<p>judgement\u00a0of\u00a0this\u00a0court\u00a0in\u00a0the\u00a0case\u00a0of \u00a0Sri\u00a0Sai\u00a0Stone\u00a0Crusher\u00a0and\u00a0<\/p>\n<p>others\u00a0vs.\u00a0State\u00a0of\u00a0U.P.\u00a0&amp;\u00a0others\u00a0decided\u00a0on\u00a011.4.2008\u00a0wherein\u00a0it\u00a0<\/p>\n<p>has\u00a0been\u00a0held\u00a0that\u00a0once\u00a0the\u00a0transit\u00a0fee\u00a0has\u00a0already\u00a0been\u00a0paid\u00a0for\u00a0<\/p>\n<p>transportation\u00a0of\u00a0raw\u00a0materials,\u00a0no\u00a0transit\u00a0fee\u00a0is\u00a0payable\u00a0for\u00a0finished\u00a0<\/p>\n<p>goods, \u00a0 contends \u00a0 that \u00a0 the \u00a0 lower \u00a0 appellate \u00a0 court \u00a0 has \u00a0 wrongly \u00a0 and\u00a0<\/p>\n<p>illegally\u00a0refused\u00a0to\u00a0place\u00a0reliance\u00a0on\u00a0the\u00a0said\u00a0judgement\u00a0merely\u00a0on\u00a0<\/p>\n<p>the\u00a0ground\u00a0that\u00a0it\u00a0was\u00a0passed\u00a0in\u00a0the\u00a0writ\u00a0petition.\u00a0<\/p>\n<p>Prima\u00adfacie \u00a0 there \u00a0 appears \u00a0 to \u00a0 be \u00a0 force \u00a0 in \u00a0 the \u00a0 submission \u00a0 and \u00a0 the\u00a0<\/p>\n<p>petitioners\u00a0are\u00a0entitled\u00a0to\u00a0interim\u00a0order.\u00a0\n<\/p>\n<p>Until\u00a0further\u00a0orders\u00a0of\u00a0this\u00a0Court,\u00a0the\u00a0respondents\u00a0are\u00a0restrained\u00a0from\u00a0<\/p>\n<p>realising\u00a0the\u00a0transit\u00a0fees\u00a0for\u00a0transportation\u00a0of\u00a0the\u00a0finished\u00a0goods\u00a0which\u00a0<\/p>\n<p>have\u00a0been\u00a0manufactured\u00a0from\u00a0the\u00a0raw\u00a0materials\u00a0on\u00a0which\u00a0the\u00a0transit\u00a0<\/p>\n<p>fee\u00a0has\u00a0already\u00a0been\u00a0paid.\u00a0\n<\/p>\n<p>Order
