DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\napplication  filed under section 439 of the Criminal Procedure Code,<br \/>\n1973 is preferred by the applicant who is an accused  in connection<br \/>\nwith  FIR registered being 1-CR No. 65 of 2009 with  Kalavad police<br \/>\nstation for the offences punishable under sections 364, 365, 302, 201<br \/>\nand 120-B of Indian Penal Code.\n<\/p>\n<p>2.\t\tMr<br \/>\nH.A. Dave, learned Advocate appearing for the applicant submits that<br \/>\nthe involvement of the applicant is only on the basis of statement of<br \/>\nthe co-accused and   nothing is recovered or discovered and in<br \/>\nabsence of any other material in the charge sheet connecting<br \/>\nthe applicant-accused with the crime and the other co-accused are<br \/>\nenlarged by the court concerned, the applicant may also be enlarged<br \/>\non bail.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAPP submits that considering the nature of the offence and the<br \/>\napplicant being the main accused at whose behest the conspiracy was<br \/>\nhatched and ultimately offence under section 302 of the IPC was<br \/>\nregistered.  It is further submitted that certain statements of the<br \/>\nwitnesses including one  Chhaganbhai  Khatrani who has stated that<br \/>\nthe applicant had played an overt-act.  Besides, considering the<br \/>\ninjuries found on the body and other attending circumstances, the<br \/>\napplicant may not be enlarged on bail.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard the learned counsel for the parties and considering the facts<br \/>\nand circumstances, prima facie, it appears that the applicant was one<br \/>\nof the conspirators and in furtherance of the conspiracy hatched, the<br \/>\nvictim was done to death.  It further  transpires that certain mobile<br \/>\ncalls including the  call received by the present applicant from<br \/>\nother co-accused, statement of  Chhaganbhai and<br \/>\nother attending circumstances along with recovery of the cash amount<br \/>\nwould certainly go against the present applicant and the prosecution<br \/>\nhas made out a good case and rest of the things will be the subject<br \/>\nmatter of the trial.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of the aforesaid, no case is made out to grant bail to the<br \/>\napplicant.
