RAVEENDRAN\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<br \/>\n(Arising out of SLP(C) No. 21409\/2004)<\/p>\n<p>ARIJIT PASAYAT, J.\n<\/p>\n<p>\tLeave granted.\n<\/p>\n<p>\tChallenge in this Appeal is to the legality of judgment<br \/>\nrendered by a Division Bench of the Punjab and Haryana High<br \/>\nCourt dismissing the writ petition filed by the appellant who<br \/>\nhad questioned her termination of services by the respondents<br \/>\n1 to 4 i.e. State of Punjab and its functionaries. The order of<br \/>\ntermination was passed on the ground that she has tampered<br \/>\nwith her mark sheet to get employment. Enquiry was<br \/>\nconducted and it was found that she had tampered with the<br \/>\nmark sheet.\n<\/p>\n<p>\tBackground facts in a nutshell are as follows :\n<\/p>\n<p>\tAfter passing the matriculation examination, appellant<br \/>\njoined R.R. Bawa, DAV College for Girls, Batala,  Punjab under<br \/>\nthe Guru Nanak Dev  University, Amritsar, (in short the<br \/>\n&#8216;University&#8217;)  respondent No.5. In June, 1995 she passed the<br \/>\nB. Sc. (Economics), Part III examination securing 418 marks<br \/>\nout of 800 marks.  On the basis of the mark list submitted,<br \/>\nshe was admitted to the B.Ed. course under the University<br \/>\nand passed the B.Ed. examination also.  She was selected as<br \/>\nJBT teacher in a Government aided School i.e. Ved kaur Arya<br \/>\nGirls High School, Quadian, Gurdaspur for teaching<br \/>\nmathematics.  While working as a teacher she completed her<br \/>\nM.A. (Economics) examination by correspondence course from<br \/>\nPunjab University, Patiala. While she was working as JBT<br \/>\nteacher a news item was published indicating that 55 teachers<br \/>\nobtained fake degrees and their services were terminated.<br \/>\nName of appellant was one of them.  The orders of termination<br \/>\nwere passed on the basis of the orders passed by the Punjab<br \/>\nand Haryana High Court in a Public Interest Litigation.<br \/>\nAppellant came to know that the allegations so far as she is<br \/>\nconcerned related to alleged tampering of marks in B.Sc. Part<br \/>\nIII, that is she had actually secured 86 marks in Economics<br \/>\nand not 124, and in Computer Application she had secured<br \/>\n140 marks and not 102 as was shown in the mark sheet<br \/>\nproduced by her. On verification of the records from the<br \/>\nUniversity, it was clear that while her total marks remained<br \/>\nsame, there was increase in the marks of Computer<br \/>\nApplication while there was a decrease in marks of Economics.<br \/>\nA writ petition was filed challenging the termination of her<br \/>\nservices.  The High Court issued the notices to the<br \/>\nrespondents and the University. An enquiry was conducted by<br \/>\nthe University and the Enquiry Officer submitted a report<br \/>\nwhich clearly indicated that there was reduction of marks in<br \/>\none subject and increase in the other.  Stand of the appellant<br \/>\nwas that she has not got any benefit out of the alleged<br \/>\ntampering and she was not responsible for the same. But her<br \/>\nclaim was not accepted.  Though the Enquiry Officer found<br \/>\nthat she had not obtained any advantage out of it, yet the<br \/>\nEnquiry Report was to the effect that the obvious purpose for<br \/>\ntampering was to obtain a certain percentage of marks<br \/>\nrequired for being eligible for admission.  After verifying the<br \/>\ndocuments in question, it was concluded that she had<br \/>\ntampered with the mark sheet.  It was concluded that there<br \/>\nwas only one purpose with which the tampering was done i.e.<br \/>\nto take advantage in various admissions and selections in a<br \/>\ngovernment job as a teacher.  The High Court accepted the<br \/>\nreport and dismissed the writ petition.\n<\/p>\n<p>\tLearned counsel for the appellant submitted that the<br \/>\nEnquiry Officer had himself came to hold that the appellant<br \/>\nhas not taken any advantage. In any event she had higher<br \/>\nqualification than the minimum educational qualification<br \/>\nrequired for the post of a teacher and, therefore, even ignoring<br \/>\nthe disputed marks, she was clearly eligible.\n<\/p>\n<p>\tIn response, learned counsel for the respondents<br \/>\nsubmitted that one who seeks equity to be done must come<br \/>\nwith clean hands.  The various documents examined by the<br \/>\nEnquiry Officer clearly reveal that it was appellant herself who<br \/>\nwas responsible for the tampering.  Her so called ignorance<br \/>\nand claim of innocence is clearly untenable.  When it was<br \/>\nnoticed that she had been caught, a feeble plea was taken that<br \/>\nshe did not verify the correctness of the marks with the official<br \/>\nrecords.  In the records of the College from where the mark<br \/>\nsheet was taken, the correct marks were recorded. She had<br \/>\nsigned in token of having verified the marks.\n<\/p>\n<p>\tThe Enquiry Officer&#8217;s report is based on evaluation of the<br \/>\nmaterials examined by him.  There is no dispute raised by the<br \/>\nappellant that in fact she had secured 86 marks in Economics<br \/>\nand not 124, and similarly in Computer Application she had<br \/>\nsecured 140 marks and not 102.  The obvious purpose for the<br \/>\nchange as has been rightly noticed by the Enquiry Officer, is to<br \/>\nproject that she had secured certain percentage of marks<br \/>\nwhich made her eligible for admission into the higher courses.<br \/>\nIn any event, the Enquiry Officer&#8217;s conclusions cannot be<br \/>\ntermed as perverse to warrant any interference.  That being so,<br \/>\nthe action taken by the authorities cannot be faulted.\n<\/p>\n<p>But at the same time it is not disputed by the<br \/>\nrespondents that the appellant possess the minimum<br \/>\neducational qualification for admission even though the<br \/>\ntempted marks are out of consideration. Learned counsel for<br \/>\nthe respondent-State is right in his submission that a person<br \/>\nwho resorts to tampering of mark sheet should not be shown<br \/>\nany leniency. But considering the fact that she had rendered<br \/>\nabout 10 years of service without almost any blemish and<br \/>\nappears to have otherwise a good academic record, on the<br \/>\npeculiar facts of the case, the Government would do well to<br \/>\nconsider whether a fresh appointment can be given to her<br \/>\nignoring the tampered marks. Considering the peculiar<br \/>\ncircumstances, the matter may be considered in its proper<br \/>\nperspective taking into account the various factors. It is<br \/>\nentirely in the discretion of the Government, and there is no<br \/>\nmandate issued by us.\n<\/p>\n<p>\tThe appeal is disposed of accordingly.
