KRISHNAN, J\n                        -----------------------\n                    L.A.A.No. 1051 OF 2003\n                   ---------------------------------\n              Dated this the 14th day of January, 2009\n\n\n                             JUDGMENT\n<\/pre>\n<p>      This is an appeal preferred against the award of the Land<\/p>\n<p>Acquisition Court, Manjeri in L.A.R. 77\/98.     The Land Acquisition<\/p>\n<p>Court has awarded a compensation and it is against that decision<\/p>\n<p>the appeal is preferred by the Airport Director.<\/p>\n<p>      2. There were matters pending before the Division Bench of<\/p>\n<p>this court against the very same common award and L.A.A. 1052\/03<\/p>\n<p>was one filed against L.A.R. 66\/98 of the Sub Court, Manjeri. The<\/p>\n<p>Division Bench held that the Requisition Authority was not made a<\/p>\n<p>party. Therefore the Division Bench set aside the judgment and<\/p>\n<p>decree in the case and remitted the matter with a direction to<\/p>\n<p>implead the Requisitioning Authority as an additional respondent<\/p>\n<p>and answer the reference. In this case also the present appellant is<\/p>\n<p>not a party before the Land Acquisition Court. Therefore as ordered<\/p>\n<p>by the Division Bench, the judgment and decree under challenge<\/p>\n<p>are set aside and the matter is remitted back to the Land<\/p>\n<p>Acquisition Court with a direction to implead the Requisitioning<\/p>\n<p>Authority as an additional respondent and for answering the<\/p>\n<p>L.A.A. 1051\/03<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>reference as expeditiously as possible.   Parties are directed to<\/p>\n<p>appear before the lower court on 25.2.2009.<\/p>\n<p>      The appellant is entitled to refund of full court fee and<\/p>\n<p>therefore it shall be refunded to it.\n<\/p>\n<\/p>\n<p>                                         M.N.
