Justice S.SIRI JAGAN\n\n Dated :10\/01\/2008\n\n O R D E R\n                              S.SIRI JAGAN, J.\n\n                           =======================\n\n                             W.P.(C) No. 1177  of 2008(M)\n\n                           =======================\n\n                     Dated this the  10th  day of January, 2008\n\n\n\n\n                                  JUDGMENT\n<\/pre>\n<p>        The   petitioner   is   the   Kerala   State   Electricity   Board.     The<\/p>\n<p>Board   is   challenging   orders   of   the   original   and   appellate<\/p>\n<p>authorities   under   the   Payment   of   Gratuity   Act   whereby   the<\/p>\n<p>authorities   have   directed   payment   of   gratuity   to   the   1st<\/p>\n<p>respondent in accordance with the Payment of Gratuity Act.  This<\/p>\n<p>writ petition is filed on the ground that the Writ Appeal No.1062<\/p>\n<p>of   2003   on   the   question   as   to   whether   the   rules   relating   to<\/p>\n<p>gratuity   under   the   KSR   would   overwrite   the   provisions   of   the<\/p>\n<p>Payment of Gratuity Act is pending before a Division Bench.  That<\/p>\n<p>writ   appeal   is   against   a   judgment   of   a   learned   single   judge<\/p>\n<p>holding that the provisions of the Payment of gratuity  Act would<\/p>\n<p>prevail.  Now that the writ appeal is dismissed.  This writ petition<\/p>\n<p>is   also   liable   to   be   dismissed.
