BASANT, J.\n            -------------------------------------------------\n                     B.A. No. 5225 OF 2007\n            -------------------------------------------------\n         Dated this the 7th day of September, 2007\n\n                               ORDER\n<\/pre>\n<p>     Application for anticipatory bail.          The petitioner faces<\/p>\n<p>allegations under the Kerala Abkari Act.             The crux of the<\/p>\n<p>allegations against him is that the contraband articles were<\/p>\n<p>recovered from a vehicle of which he is the registered owner.<\/p>\n<p>Investigation is complete. Final report has already been filed.<\/p>\n<p>Committal proceedings has been registered.               The petitioner<\/p>\n<p>finds a warrant of arrest issued by the learned Magistrate<\/p>\n<p>chasing him.\n<\/p>\n<p>     2. According to the petitioner, he is absolutely innocent.<\/p>\n<p>He is not, in any way, connected with the vehicle now.             The<\/p>\n<p>same has been transferred to another, though such transferee<\/p>\n<p>has not so far taken any steps to get the mutation effected in<\/p>\n<p>the Registration Certificate.       It would traversity of justice if<\/p>\n<p><span class=\"hidden_text\"> B.A. No. 5225 OF 2007        -: 2 :-<\/span><\/p>\n<p>the petitioner were to be arrested and detained in custody even<\/p>\n<p>in execution of a non-bailable warrant issued by a court.       In<\/p>\n<p>these circumstances, it is prayed that powers under Sec.438 of<\/p>\n<p>the Cr.P.C. may be invoked in favour of the petitioner &#8211; an Ex-<\/p>\n<p>service man.\n<\/p>\n<p>      3. Notice was given to the learned Public Prosecutor. The<\/p>\n<p>learned Public Prosecutor was requested to pointedly explain to<\/p>\n<p>this Court the precise nature of the allegation against the<\/p>\n<p>petitioner.  Except that the petitioner continues to be the<\/p>\n<p>registered owner of the vehicle, no other circumstances are<\/p>\n<p>pressed into service to indicate the complicity of the petitioner.<\/p>\n<p>The transferee from the petitioner has been ascertained by the<\/p>\n<p>Investigator.\n<\/p>\n<p>      4.  I have considered all the relevant inputs.   It is trite,<\/p>\n<p>after the decision in Bharat Chaudhary and another v. State<\/p>\n<p>of Bihar (AIR 2003 SC 4662), that the powers under Sec.438<\/p>\n<p>of the Cr.P.C. can be invoked even in a case where the<\/p>\n<p>apprehended arrest is in execution of a non-bailable warrant<\/p>\n<p>issued by a court after taking cognizance.      In the facts and<\/p>\n<p>circumstances to which I have made a brief reference above, I<\/p>\n<p>am satisfied that this is an eminently     fit case where such<\/p>\n<p>discretion can and ought to be invoked in favour of the<\/p>\n<p><span class=\"hidden_text\"> B.A. No. 5225 OF 2007          -: 3 :-<\/span><\/p>\n<p>petitioner.\n<\/p>\n<p>      5.   In the result, this petition is allowed.       Following<\/p>\n<p>directions are issued under Sec.438 of the Cr.P.C:<\/p>\n<p>      (i) The warrant of arrest issued against the petitioner shall<\/p>\n<p>not be executed till 15\/9\/2007.\n<\/p>\n<p>      (ii) The petitioner shall surrender before the learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m. on 15\/9\/07. He shall be<\/p>\n<p>released on bail on his executing a bond for Rs.25,000\/- without<\/p>\n<p>any sureties.\n<\/p>\n<p>      (iii) The petitioner shall make himself available for<\/p>\n<p>interrogation before the Investigating Officer as and when<\/p>\n<p>directed by the Investigating Officer in writing to do so.<\/p>\n<p>                                                     Sd\/-\n<\/p>\n<p>                                              (R.
