He filed claim petition against<br \/>\n\trespondents herein for allegedly having suffered injuries in a<br \/>\n\tvehicular accident. Claim was filed way back in the year 1991. It is<br \/>\n\tthe case of the petitioner that before the Lok Adalat, claim<br \/>\n\tpetition was compromised  between the petitioner and insurance<br \/>\n\tcompany for sum of Rs.15,500\/- on 14.3.1993.  However, the Insurance<br \/>\n\tCompany did not deposit the said amount and ultimately claim<br \/>\n\tpetition came to be dismissed for want of prosecution on 29.9.2001.<br \/>\n\tAccording to the petitioner, he did not know about such dismissal.<br \/>\n\tHis advocate used to assure him that whenever claim petition is<br \/>\n\ttaken up for hearing, he would be informed. Eventually other<br \/>\n\tclaimants who had also received injuries during same accident<br \/>\n\treceived an order of compensation in the year 2009, thereupon the<br \/>\n\tpetitioner came to know about the proceedings. On inquiry, it was<br \/>\n\tfound that case had been dismissed in the year 2001. The petitioner<br \/>\n\tthereupon filed application for restoration and delay condonation.<br \/>\n\tClaims Tribunal dismissed the application by a reasoned order dated<br \/>\n\t16.4.2010. Hence the petition.\n<\/p>\n<p>From<br \/>\n\tthe record, it clearly emerges that alleged incident took place on<br \/>\n\t11.4.1991. The Claim Petition was dismissed after pendency of may be<br \/>\n\tten years. In the meantime as per the petitioner, there was a<br \/>\n\tcompromise in the Lok Adalat. If Lok Adalat had already resolved the<br \/>\n\tdisputes, I fail to see how Claim Petition could have been kept<br \/>\n\talive. In any case, there is nothing on record to establish such<br \/>\n\tcompromise. In any case, tribunal proceeded further with the claim<br \/>\n\tpetition and found that neither the petitioner nor his advocate were<br \/>\n\tinterested in prosecuting the claim. Another nine years passed<br \/>\n\tbefore the petitioner moved the Court for restoration and<br \/>\n\tcondonation of delay. For the accident which took place nearly 20<br \/>\n\tyears back, it would be quite impossible to get necessary record.<br \/>\n\tAllowing the petition and restoring the claim petition would only<br \/>\n\tgive false hope to the claimant whose case eventually is most<br \/>\n\tunlikely to result in any compensation being awarded.\n<\/p>\n<p>Looking<br \/>\n\tto the totality of facts and circumstances of the case, I do not<br \/>\n\tfind any reason to interfere.
