BASANT, J.\n\n              -------------------------------------------------\n\n                        B.A. No. 1104 of   2008\n\n              -------------------------------------------------\n\n          Dated this the  25th day of  February, 2008\n\n\n                                 ORDER\n<\/pre>\n<p>      Application   for   anticipatory   bail.       The   petitioners   are<\/p>\n<p>accused   1   to   5.     They   are   the   husband   of   the   de   facto<\/p>\n<p>complainant   and   his   relatives.       Marriage   took   place   on<\/p>\n<p>15\/4\/07.     Allegations are raised of the offence of matrimonial<\/p>\n<p>cruelty punishable under Sec.498A of the IPC.  Cognizance has<\/p>\n<p>been taken on the basis of a private complaint filed by the de<\/p>\n<p>facto complainant  before  the learned Magistrate and  referred<\/p>\n<p>by the learned Magistrate to the police under Sec.156(3) of the<\/p>\n<p>Cr.P.C.  Investigation is in progress. The petitioners apprehend<\/p>\n<p>imminent arrest.\n<\/p>\n<\/p>\n<p>      2.     The learned counsel for the petitioners submits that<\/p>\n<p>the   petitioners   are   absolutely   innocent.       The   1st  accused\/the<\/p>\n<p>husband   is   a   deaf   and   dumb   person.     Frustrations   and<\/p>\n<p><span class=\"hidden_text\">  B.A. No. 1104 of   2008           -: 2 :-<\/span><\/p>\n<p>disappointments   in   marriage   are   prompting   the   de   facto<\/p>\n<p>complainant   to   raise   reckless   and   exaggerated   allegations.<\/p>\n<p>Arrest  and  incarceration  of the  petitioners is likely  to close  the<\/p>\n<p>doors   permanently   on   any   possibility   of   harmonious   settlement<\/p>\n<p>of the matrimonial dispute.   The petitioners are willing to abide<\/p>\n<p>by   any   conditions.       They   may   be   granted   anticipatory   bail<\/p>\n<p>subject to appropriate conditions, prays the learned counsel for<\/p>\n<p>the petitioners.\n<\/p>\n<\/p>\n<p>      3.     The   learned   Public   Prosecutor   does   not   oppose   the<\/p>\n<p>application.       The   learned   Public   Prosecutor   reports   that   the<\/p>\n<p>alleged   victim\/the   de   facto   complainant   is   not   shown   to   have<\/p>\n<p>suffered any injury consequent to the alleged infliction of cruelty<\/p>\n<p>on her by the petitioners.\n<\/p>\n<\/p>\n<p>      4.  Having considered all the relevant inputs, I am satisfied<\/p>\n<p>that anticipatory bail can be granted to the petitioners subject to<\/p>\n<p>appropriate   conditions   which   shall   ensure   the   interests   of   a<\/p>\n<p>proper investigation.\n<\/p>\n<\/p>\n<p>      5.  In   the   result,   this   petition   is   allowed.     Following<\/p>\n<p>directions are issued under Sec.438 of the Cr.P.C:<\/p>\n<p>      (i)   The   petitioners   shall   appear   before   the   learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m. on 3\/3\/08.   They  shall<\/p>\n<p><span class=\"hidden_text\">  B.A. No. 1104 of   2008              -: 3 :-<\/span><\/p>\n<p>be   released   on   regular   bail   on   their     executing     bonds   for<\/p>\n<p>Rs.25,000\/- each with two solvent sureties each for the like sum<\/p>\n<p>to the satisfaction of the learned Magistrate.<\/p>\n<p>      (ii)   The   petitioners   shall   make   themselves   available   for<\/p>\n<p>interrogation before the  Investigating Officer  between 10 a.m.<\/p>\n<p>and   3   p.m.   on   4\/2\/08   and   5\/2\/08.       During   this   period   the<\/p>\n<p>Investigator   shall   be   at   liberty   to   interrogate   the   petitioners   in<\/p>\n<p>custody   and   take   all   necessary   steps   for   the   proper   conduct   of<\/p>\n<p>the investigation.   Thereafter the petitioners shall appear before<\/p>\n<p>the  Investigating  Officer  on all  Mondays and Fridays between<\/p>\n<p>10 a.m. and 12 noon for a period of one month.     Subsequently,<\/p>\n<p>they shall so make themselves available for interrogation before<\/p>\n<p>the  Investigating   Officer  as   and   when   directed   by   the<\/p>\n<p>Investigating Officer in writing to do so.\n<\/p>\n<\/p>\n<p>      (iii)       If   the   petitioners   do   not   appear   before   the   learned<\/p>\n<p>Magistrate as directed in clause (i),  directions issued above shall<\/p>\n<p>thereafter   stand   revoked   and   the   police   shall   be   at   liberty   to<\/p>\n<p>arrest the petitioners and deal with them in accordance with law<\/p>\n<p>as if these directions were not issued at all;<\/p>\n<p>      (iv)  If the petitioners were arrested prior to their surrender<\/p>\n<p><span class=\"hidden_text\">  B.A. No. 1104 of   2008         -: 4 :-<\/span><\/p>\n<p>on 3\/2\/08 as directed in clause (i) above,   they shall be released<\/p>\n<p>on   their   executing   bonds   for   Rs.25,000\/-   each   without   any<\/p>\n<p>sureties undertaking to appear before the learned Magistrate on<\/p>\n<p>3\/2\/08.\n<\/p>\n<\/p>\n<p>                                                 (R.
