Instead the respondent no.3 has<br \/>\n\tcharged compound interest.\n<\/p>\n<p>Mr.A.K.\n<\/p>\n<p>\tClerk, learned advocate appearing for respondent no.3-Bank, invited<br \/>\n\tattention of the Court to the averments made in the<br \/>\n\taffidavit-in-reply filed on behalf of respondent no.3, wherein it is<br \/>\n\tspecifically submitted that :\n<\/p>\n<p>?S15.\n<\/p>\n<p> .. .. The answering respondent had re-checked the calculation of<br \/>\ninterest in the account of the petitioner and it was found that for<br \/>\nthe period from 29.1.02 to 4.6.02 compound interest was charged.<br \/>\nTherefore, an amount of Rs.744\/- being the difference between the<br \/>\ncompound interest and simple interest was credited in the account of<br \/>\npetitioner on 24.2.07 and thereafter the simple interest has been<br \/>\ncalculated. .. ..??\n<\/p>\n<p>In<br \/>\n\tview of aforesaid averments in the affidavit-in-reply, the question<br \/>\n\tbecomes disputed question of facts which this Court cannot go into<br \/>\n\twhile exercising powers under Article 226 of the Constitution of<br \/>\n\tIndia. The present petition, therefore, fails. The same is<br \/>\n\tdismissed. Notice is discharged.\n<\/p>\n<p>Mr.C.H.\n<\/p>\n<p>\tVora, learned advocate appearing for petitioner, requests that it be<br \/>\n\tclarified that the dismissal of this petition on account of<br \/>\n\tinvolvement of disputed questions of facts may not prejudice the<br \/>\n\tright of the petitioner to agitate the said question before an<br \/>\n\tappropriate authority\/Court.\n<\/p>\n<p>It<br \/>\n\tgoes without saying that the petitioner will be at liberty to<br \/>\n\tagitate this question before appropriate forum\/ Court and his right<br \/>\n\tdoes not get prejudiced by dismissal of this petition.\n<\/p>\n<p>(Ravi<br \/>\nR.
