Justice P.S.GOPINATHAN\n\n Dated :19\/05\/2009\n\n O R D E R\n                       P.S GOPINATHAN, J.\n                 --------------------------------------\n                       B.A. No.2726 of 2009\n                  --------------------------------------\n                        Dated: MAY 19, 2009\n\n                             ORDER\n<\/pre>\n<p>      Petitioner is the 5th accused in Crime No.23\/CR\/S1\/2009 of<\/p>\n<p>CBCID, Thiruvananthapuram for offences          under sections 468,<\/p>\n<p>471, 420 and 120B IPC. Apprehending arrest and detention at<\/p>\n<p>the hands of the investigating officer, the petitioner sought an<\/p>\n<p>order    under    sec.438    IPC   before    the   Sessions  Judge,<\/p>\n<p>Thiruvanthapuram.        By Annexure I order the request was<\/p>\n<p>declined. Now this petition.\n<\/p>\n<p>      2.   Today when the petition came up for hearing it is<\/p>\n<p>submitted       that     the     Additional      Sessions    Judge,<\/p>\n<p>Thiruvananthapuram has granted similar relief to the 1st accused.<\/p>\n<p>In the above circumstances I find no reason to deny the same<\/p>\n<p>relief to the petitioner.\n<\/p>\n<p>      3.
