is gainfully employed as Agricultural Development   <\/p>\n

was not consummated, they did not havethe relartioriship’ <\/p>\n

8. In the light of earlier round of litigation =<\/p>\n
petitioner and respondent in Various Courts  V’<\/p>\n
and Madras High Court at Chennai~it.isg   is Ru<\/p>\n
suppression of material facts by  be_fore <\/p>\n
Admittedly, marriage has  place onl,  * it<\/p>\n
petitioner -\u00bb~ wife lived with respondentg only “fo.r_a_tew days
\nintermittently from 13. I1.  , on which day<\/p>\n
she leftavmatrirnolnialidliousel’permanently. Subsequent to wife
\nwalking out   house, respondent\/husband<\/p>\n
 attempts” todget her back by sending mediators from<\/p>\n
this which was not entertained by wife and her family<\/p>\n
 notice is also issued by husband to<\/p>\n
wife’;\u00ab\u00ab.wlo.erein’ it is clearly stated that petitioner did not stay<\/p>\n

  her parents house and did not stay with her husband in<\/p>\n

husband filed a petition under Section 9 of the Hindu<\/p>\n
Marriage Act seeking restitution of conjugal <\/p>\n
his wife on 20.7 .1998 on the fiie of Court  V’<\/p>\n
Judge, Krishnagiri, in which a counter is   ‘resp.on’dent.. 99<\/p>\n
~ wife refusing to join petitioners  the ground  I<\/p>\n

has expressed her inability toggwithgi hirn” prayed for<\/p>\n

9  Against which a revision petition was \ufb01led by<\/p>\n
.9    Cr1.RC.No.i442\/2002, which was aiso dismissed<\/p>\n
 “holding that she has not made out any grounds to secure<\/p>\n

\nrespondent is not consummated and inspite of his best<\/p>\n
efforts she has refused to come and join him. Even Vinthe<\/p>\n

which was raised by her before <\/p>\n

threat to her life from h”ert h.1isbaZf1@i there was demand<\/p>\n
for   the of Subordinate Judge,
\nKrishnagiri  is con\ufb01rmed by order dated<\/p>\n

  –v.._wifeAxhasmiserably failed to establish all these<\/p>\n
  in.:_procee’dings, which are filed in the Courts in Tamil<\/p>\n
 the Court, Bangalore ought to have taken<\/p>\n
nottce~.of}_that and decided the claim of petitioner on the<\/p>\n

11. In the instant case, the Trial Court has over looked
\nall the documents on record and has misdirected itself to
\ntake a sympathetic View on the petitioner -~ wife holding that<\/p>\n
she does not have any source of income to maintair1″‘heifse1f<\/p>\n
and she is entitled to be maintained by her huslziandr,  ‘<\/p>\n
a permanent employee of Tamil   if<\/p>\n
salary of more than R,s.14,000\/–\n<\/p>\n
certificate that is produced ‘~:t1:earlyl–‘;that r L’<\/p>\n
though his salary is take “hoVmeJsala1y is
\nRs.3,000\/~, which cannot  is because, the<\/p>\n
deduction of a sum of:.Rs;\u00bb10tOf)Qf;–__ refund of GP?<\/p>\n
clear1y:’tVdiscloses  azlarge  of his salary is being
\ndeducted llrepa:j;irne.7:1t of loan. Otherwise, the<\/p>\n
husband vlIo’u1d’ have fr-eceitrled a salary of about Rs. 13,000\/-<\/p>\n

Court of Subordinate Judge, Krishnagiri, in M.C.,<\/p>\n
proceedings \ufb01led by husband, wherein a sum of Rs.5()0__\/_– is<\/p>\n
ordered to be paid as maintenance to wife, <\/p>\n
con\ufb01rmed by the High Court of Judicature at: 1 ”<\/p>\n
CRP(PD) No.839\/ 2005. ‘l’l’1erefore,g~i;hereg is-‘_:no_i <\/p>\n
for the trial Court to award  <\/p>\n
petition filed under Section  ‘ . if<\/p>\n
12. It is a peculia;’e.ase w’fiere.:’wife~.has noteven stayed
\nfor few days in rr1at1’imionialV1 l1ot_isl’e\u00a2.AA.’~V.VFb1″\u00a5*’%?1″riage is not<\/p>\n
consummated,_..she1~.has ..__jo’inj her husband on<\/p>\n
severahfalse, flimsy grounds, all of which are
\nproved  false ,.la”-jiroceeding before the Court of<\/p>\n

When  \u00abhas  neglected to discharge her<\/p>\n
obligation as ~legal1y~. wedded wife of respondent, she cannot<\/p>\n

   of wife. Under the circumstances, this<\/p>\n
