Learned APP Mr. Jani waives service of Rule on behalf of the
\nrespondent – State.\n<\/p>\n
\tThe
\napplicant has filed this application for suspending the sentence
\nawarded by Judgment and order dated 23.3.2011 passed by the learned
\nSpecial Jduge, Bhavnagar, Camp at Boatad, in Special Atrocity Case
\nNo.16 of 2009 and to release the applicant on bail, pending the
\nhearing of Criminal Appeal No.421\/11.\n<\/p>\n
\tLearned
\nAdvocate Mr. Surti has contended that during the trial, the applicant
\nwas on bail and after awarding the sentence by the learned Special
\nJudge, the applicant has surrendered before the Authority.\n<\/p>\n
\tIn
\nthe facts of the case, the application is allowed. The applicant is
\nordered to be enlarged on bail on his executing a personal bond of
\nRs.10,000\/- and on usual terms and conditions. Bail before the trial
\nCourt. Rule made absolute accordingly. D.S. Permitted.\n<\/p>\n
