BASANT, J.\n\n               -------------------------------------------------\n\n                        B.A.NO. 4122 OF  2007\n\n               -------------------------------------------------\n\n                Dated this the  9th day of July, 2007\n\n\n\n                                  ORDER\n<\/pre>\n<p>      Application   for   anticipatory   bail.     The   petitioner   is   the<\/p>\n<p>husband of the de facto complainant.   The marriage took place<\/p>\n<p>on 29\/4\/04.    A child has been born in the wed-lock.   There is<\/p>\n<p>strain   in   the   matrimonial   relationship.              The   de   facto<\/p>\n<p>complainant   has   filed   a   private   complaint   which   has   been<\/p>\n<p>referred   to   the   police   under   Sec.156(3)   of   the   Cr.P.C.\n<\/p>\n<p>Investigation   is   in   progress.       The   petitioner   apprehends<\/p>\n<p>imminent arrest.\n<\/p>\n<p>      2.     The   learned   counsel   for   the   petitioner   prays,   the<\/p>\n<p>learned   Public   Prosecutor   does   not   seriously   oppose   the   said<\/p>\n<p>prayer and I am satisfied that directions under Sec.438 of the<\/p>\n<p>Cr.P.C. can be issued in favour of the petitioner.    In coming to<\/p>\n<p>this   conclusion,   I   take   note   of   the   submission   of   the   learned<\/p>\n<p><span class=\"hidden_text\"> B.A.NO. 4122 OF  2007                -: 2 :-<\/span><\/p>\n<p>counsel for the petitioner that if the petitioner were arrested and<\/p>\n<p>detained   in   custody,   that   would   mar   all   possibilities   of<\/p>\n<p>harmonious   settlement   of   the   dispute   between   the   parties.\n<\/p>\n<p>Subject   to   appropriate   conditions,   anticipatory   bail   can   be<\/p>\n<p>granted to the petitioner,  I am satisfied.\n<\/p>\n<p>      3.   In   the   result,   this   petition   is   allowed.     Following<\/p>\n<p>directions are issued under Sec.438 of the Cr.P.C:\n<\/p>\n<p>      (i)   The   petitioner   shall   appear   before   the   learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m. on 16\/7\/07.  He shall be<\/p>\n<p>released on regular bail on his executing a bond for Rs.25,000\/-\n<\/p>\n<p>with two solvent sureties each for the like sum to the satisfaction<\/p>\n<p>of the learned Magistrate.\n<\/p>\n<p>      (ii)   The   petitioner   shall   make   himself   available   for<\/p>\n<p>interrogation before the  Investigating Officer  between 10 a.m.<\/p>\n<p>and 3 p.m. on 17\/8\/07 and 18\/7\/07 and thereafter on all Mondays<\/p>\n<p>and   Fridays   between   10   a.m.   and   12   noon   for   a   period   of   two<\/p>\n<p>months.     Subsequently,   he   shall   so   make   himself   available   for<\/p>\n<p>interrogation   before   the  Investigating   Officer  as   and   when<\/p>\n<p>directed by the Investigating Officer in writing to do so.\n<\/p>\n<p>      (iii)       If  the   petitioner  does   not  appear  before   the   learned<\/p>\n<p>Magistrate as directed in clause (i),  directions issued above shall<\/p>\n<p>thereafter   stand   revoked   and   the   police   shall   be   at   liberty   to<\/p>\n<p><span class=\"hidden_text\"> B.A.NO. 4122 OF  2007               -: 3 :-<\/span><\/p>\n<p>arrest the petitioner and deal with him in accordance with law as<\/p>\n<p>if those directions were not issued at all;\n<\/p>\n<p>        (iv)    If  the  petitioner  were   arrested  prior  to  his  surrender<\/p>\n<p>on 16\/7\/07 as directed in clause (i) above, he shall be released on<\/p>\n<p>his   executing   a   bond   for   Rs.25,000\/-   without   any   sureties<\/p>\n<p>undertaking to appear before the learned Magistrate on 16\/7\/07.\n<\/p>\n<p>                                                                 Sd\/-\n<\/p>\n<p>                                                    (R.
