           This revision petition is directed against a<\/p>\n
concurrent verdict of guilty, conviction and sentence in a<\/p>\n
prosecution under Section 20(b)(ii) of the NDPS Act. The<\/p>\n
petitioner now faces a sentence of rigorous imprisonment for<\/p>\n
a period of six months for the offence punishable under<\/p>\n
Section 20(b)(ii) of the NDPS Act.\n<\/p>\n
      2.   The crux of the allegations against the petitioner is<\/p>\n
that on 23.8.03 when the police party consisting of PWs 3 to<\/p>\n
5, on receipt of prior information that sale of ganja was taking<\/p>\n
place in the shop of the petitioner, reached the shop of the<\/p>\n
petitioner, on search of the premises, 18 small packets of<\/p>\n
ganja in a plastic cover was recovered by him. 10 gm were<\/p>\n
taken for sampling. Mahazar Ext.P1 was prepared. PWs 1<\/p>\n
and 2 are allegedly independent witnesses who had signed in<\/p>\n

the mahazar. The petitioner was arrested.<\/p>\n
      3.      After completing the investigation, final report was<\/p>\n
filed and cognizance was taken by the learned Magistrate.<\/p>\n
The accused appeared before the learned Magistrate. He<\/p>\n
denied the offences alleged against him whereupon PWs 1 to<\/p>\n
8 were examined and Exts.P1 to P5 were marked by the<\/p>\n
prosecution.\n<\/p>\n
      4.     PWs 1 and 2, as stated earlier, are the<\/p>\n
independent attestors to Ext.P1 seizure mahazar. Both of<\/p>\n
them admitted their signatures in Ext.P1 but denied having<\/p>\n
seen the seizure. PWs 3 to 5 are the police officials who<\/p>\n
constituted the party, PW5 being the senior most officer.<\/p>\n
Ext.P1 is the seizure mahazar prepared by PW5. Ext.P2 is<\/p>\n
the search list and Ext.P3 is the search memo. Ext.P4 FIR<\/p>\n
was promptly registered.       Investigation was conducted by<\/p>\n
PW7 who got the sample forwarded to PW6 who issued<\/p>\n
Ext.P5 certificate to confirm that the article seized was ganja.<\/p>\n
PW8 is a person who allegedly weighed ganja.              He also<\/p>\n

turned hostile to the prosecution.\n<\/p>\n
      5.     The accused took up a defence of total denial.<\/p>\n
According to him, there was no recovery effected from his<\/p>\n
premises. No defence evidence was adduced.<\/p>\n
      6.     The   learned   Magistrate  on   an   anxious<\/p>\n
consideration of all the relevant inputs, came to the<\/p>\n
conclusion that the oral evidence of PWs 3 to 5 which is<\/p>\n
supported by the contents of the contemporaneous Ext.P1<\/p>\n
seizure mahazar as also Exts.P2 to P4 can be safely<\/p>\n
accepted and that such evidence when accepted clearly<\/p>\n
reveals the complicity of the petitioner.  Accordingly, the<\/p>\n
learned Magistrate       proceeded to pass the impugned<\/p>\n
judgment.       The learned Sessions Judge in appeal re-<\/p>\n
appreciated and evaluated the entire materials and came to<\/p>\n
the conclusion that the verdict of guilty, conviction and<\/p>\n
sentence do not warrant any interference.<\/p>\n
      7.     The petitioner claims to be aggrieved by the<\/p>\n
impugned concurrent judgments. Called upon to explain the<\/p>\n

nature of challenge, which the petitioner wants to mount<\/p>\n
against the impugned concurrent judgments,        the learned<\/p>\n
counsel for the petitioner submits that the courts below erred<\/p>\n
in accepting and acting upon the oral evidence of PWs 3, 4<\/p>\n
and 5. In view of the hostility of PWs 1, 2 and 8 alleged<\/p>\n
independent witnesses, the courts below should not have<\/p>\n
accepted the oral evidence of PWs 3 to 5, it is contended.<\/p>\n
      8.     I find absolutely no merit in these contentions.<\/p>\n
PWs 3 to 5 are police officials charged with a responsibility of<\/p>\n
detecting offences and bringing the offenders to book. They<\/p>\n
cannot be reckoned as interested witnesses whose testimony<\/p>\n
deserves to be approached with doubt, suspicion and<\/p>\n
reservation. It is to note that no case has been advanced that<\/p>\n
PWs 3 to 5 have any animus against the petitioner and are in<\/p>\n
any way interested in foisting a false case against the<\/p>\n
petitioner. The evidence of PWs 1 and 2, though hostile,<\/p>\n
gives respectability to Ext.P1 seizure mahazar, signature in<\/p>\n
which is admitted by them.             The contents of the<\/p>\n

\n                               : 5 :<\/span><\/p>\n
contemporaneous Ext.P1 seizure mahazar supports the oral<\/p>\n
evidence of PWs 3 to 5.\n<\/p>\n
      9.     No other contentions are raised on merits. I have<\/p>\n
gone through the impugned judgments. I am satisfied that the<\/p>\n
verdict of guilty and conviction and absolutely justified and are<\/p>\n
unexceptionable. In the absence of challenge on any specific<\/p>\n
grounds, it is not necessary for me to advert to facts in any<\/p>\n
greater detail.\n<\/p>\n
      10. The learned counsel for the petitioner finally prays<\/p>\n
that leniency may be shown on the question of sentence. The<\/p>\n
petitioner faces rigorous imprisonment for a period of six<\/p>\n
months under Section 20(b)(ii) of the NDPS Act. When small<\/p>\n
quantity of ganja alone is involved, the maximum sentence<\/p>\n
that can be imposed is imprisonment for six months or fine or<\/p>\n
both. The learned Magistrate has saved the petitioner of the<\/p>\n
obligation to pay any fine but has imposed the maximum<\/p>\n
sentence of imprisonment permissible under law. It is prayed<\/p>\n
that leniency may be shown on the question of sentence. The<\/p>\n

petitioner has already undergone imprisonment for a period<\/p>\n
exceeding four months, it is submitted.       In the facts and<\/p>\n
circumstances of this case, I find absolutely no reason to take<\/p>\n
any lenient view in the matter. The ganja was stored for sale<\/p>\n
in a shop. I am satisfied, in these circumstances, that no<\/p>\n
further leniency also deserves to be shown.<\/p>\n
      11. This Crl.R.P. is, in these circumstances, dismissed.<\/p>\n
