Per contra  ljlearned l  -counsel for\nrespondent\/insurer  judgment and\naward   for dismissal of\n\nthe  that compensation\n\nawarded itselfi's.:on,llth:el"'higher side and claimant is not\nentitiedlllfarl  enlianeiement in this appeal.\n\n  Iflavlingvheard the learned advocates appearing\n\n'  and on perusal of the judgment and\n\n_l.pa_ss:ed by the tribunal as also the Tribunal\n\nrecords It would emerge that on 26~2~2007 at about 7\n\n  when the claimant was travelling in a Vehicle\n\nl  l\u00e9bearing No.KA 09 A 3420 on Mysore--Bangalore road\n\n\n\nthe driver of the said Vehicle drove in a rash and\n\nnegligent manner and dashed against the boclyxgof a\n\nTrailer. On account of the said aectidentz-..t:1a1'ni'1ai1t\n\nsustained injuries and as such claim petition was filedu \n\nseeking compensation. On' aeeo1;int"._'o--fW1nju.y;ies\n\nsustained in the accident-.__in qiies'tionat'elairnant; \n\nadmitted to District Hosptia1,"Mandya\/,, 'C.asualit.y and on\n\nexamination of ela.irr1\u00abant_Ai't_   by the treating\n\ndoctors that .\u00bb.eVlaim:ant..ijhadgg'=__siil"feredll the following\ninjuries: _   \nllll tiff)' right elbow about\nl":'i2'.4).Vlt _  wound over the anterior\nA   iliac spine.\n2  (ti\u00e9}__ Blttnltlinjuries to right hip # Iller 1\/3"!'\n   "femur.\nV.l.'i'*Vi5:;j'?l..:'uLacerated wound over the Right\n. V H forearm 5.3 1\/2 om.\nV  They suspected # and advised x-ray. X\u00bb\n ray taken confirmed the Comrnunited\n\n 1\n\nsubtrochanter # of rightfemur."\n\n\n\nTo establish this fact claimant has produced wound\ncertificate which is at Ex.P.4. Claimant on obta'i\u00bbning\n\ntreatment was clinically examined on  \n\nP.W.2 and on such clinical and radiologir:e._l,,. :eXaIT1:in=.ati.oii-\u00ab.. \n\nof the claimant doctor noticed the fol.leoiviia.g{:4.,.l  4' V\n\n"{ 1'} Shortening -of the rioht  \n{ii} Right side    1 \naw Movesijients"llofi\ufb01oltfi.2thelfig'ht"lhip &\nkneejoint   V\n{iv}  lexi,orL'\u00bb.right* llimited about\n h'tp"joint limited about\n_ it   d'e;@__8ues_ ..\n X~'rqy'  shows fracture of femur\n\nunited .ujf.thA 'thickening of callus. "\n\n  On  of said clinical and radiological\n\n  eygainination\ufb01octor has opined that there was disability\n\nto  of 35% to the right leg and 17% to the\n\n whole hody. Claimant was an inpatient. from 26e2~200'7\n\nl."li.AA"t'o.._2:';3~3~2O07 as evidenced by the discharge card which\n\n at Ex.P.5. Tribunal while awarding compensation\n\nac"\n\n\n\n6\n\nunder the heading "medical expenses and conveyance\nand nourishment charges" has awarded a,V.su'rIi_V of\n\nRs.6,O0O\/M and Rs.5,OOO\/M\u00bb respectively. \n\nadmittedly produced medical billsas  = . \n\n(21 bills] totaling a sum of   ribs\/\u00bb:\u00a2;ve:;9,\ntribunal has awarded only-"Va'--surnllovf'\nthat claim of the pe_titionerVj4_l:aizipears  gaiorbitant.\nOn examination of    reconsideration\nof the eviden\u00a2\u00a7'.t\u00a2nderedh*.l\u00a7yVtheellairnialiitd as well as the\n\ndoctor, I  of:.t.T:i.eeonlsiderredlvvviewmthat an additional\n of to be awarded under\n\nthis head  it is awarded.\n\n .7. On" a,ccount"-of'; injuries sustained claimant has\n\n dis_abilitV3'}""ll as opined by doctor P.W.2 and\n\n    is disability to the right leg to an extent\n\nof 3.50\/o__"onafaecount of which claimant would not be able\n\n to___ disiehaige his normal duties and there would be\n\n"'::o'nsiderable loss of amenities in life which requires to\n\n%\/V\n\n\n\nbe suitably compensated and hence an additional sum\nof Rs.l0,000\/- deserves to be awarded towa1'dvsVl'l.o:ss_ ogn\namenities and accordingly same is awarded'.__\u00a7':"'*\u00ab.' P.W.2 the doctor has stated *\n\nto undergo one more operationlfor \nTribunal considered said  \nof Rs.4,000\/-- towards  on the\nlower side and and   Rs.3,000\/- if\nawarded wo'uld:1n__eet itlie'  and it would be\njust and.
