Justice K.T.SANKARAN\n\n Dated :25\/11\/2009\n\n O R D E R\n                        K.T.SANKARAN, J.\n                  ---------------------------------------------\n                         B.A.No.6788 of 2009\n                  ---------------------------------------------\n           Dated this the 25th day of November, 2009\n\n\n\n                               ORDER\n<\/pre>\n<p>      This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure.                     The petitioners are<\/p>\n<p>accused   Nos.1    and      2    in     Crime       No.1108     of   2009   of<\/p>\n<p>Karunagappally Police Station.\n<\/p>\n<p>     2.    The offences alleged against the petitioners are under<\/p>\n<p>Sections 323 and 498A read with Section 34 of the Indian Penal<\/p>\n<p>Code.\n<\/p>\n<p>     3.    Heard the learned counsel for the petitioners and the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<p>     4.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioners.<\/p>\n<p>     There will be a direction that in the event of the arrest of<\/p>\n<p>the petitioners, the officer in charge of the police station shall<\/p>\n<p>release them on bail on their executing bond for Rs.10,000\/-<\/p>\n<p>each with two solvent sureties for the like amount to the<\/p>\n<p><span class=\"hidden_text\">BA No.6788\/2009                    2<\/span><\/p>\n<p>satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<\/p>\n<p>a)    The petitioners shall appear before the investigating officer<br \/>\n      for interrogation as and when required;<\/p>\n<p>b)    The petitioners shall not try to influence the prosecution<br \/>\n      witnesses or tamper with the evidence;<\/p>\n<p>c)    The petitioners shall not commit any offence or indulge in<br \/>\n      any prejudicial activity while on bail;<\/p>\n<p>d)    In case of breach of any of the conditions mentioned above,<br \/>\n      the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed to the extent indicated<\/p>\n<p>above.\n<\/p>\n<\/p>\n<p>                                               K.T.SANKARAN,<br \/>\n                                                   JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Midhun Raj vs The State Of Kerala on 25 November, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6788 of 2009() 1.
