RADHAKRISHNAN, J.\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n            W.P.(C).No.24483 of 2009-E\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n      Dated this the 26th day of August, 2009.\n\n                     JUDGMENT\n<\/pre>\n<p>1.The petitioner seeks a declaration that he is<\/p>\n<p> entitled to his professional fee and service tax<\/p>\n<p> thereon from the first respondent Municipality<\/p>\n<p> for the architectural works executed by him. He<\/p>\n<p> seeks such declaration on the strength of Clause<\/p>\n<p> 1 of the agreement between the parties and relies<\/p>\n<p> on Ext.P4 Government Order. He seeks a further<\/p>\n<p> relief to quash Exts.P8 and P8A decisions of the<\/p>\n<p> Municipality and Ext.P11 order where the learned<\/p>\n<p> Ombudsman for Local Self Government Institutions<\/p>\n<p> refused to interfere with, at the instance of the<\/p>\n<p> petitioner, taking the view that the matter is<\/p>\n<p> one for determination before a civil court. He<\/p>\n<p> also seeks a direction to the Municipality and<\/p>\n<p> its officers to pay an amount of Rs.8.5 lakhs as<\/p>\n<p> balance   professional   fee   with  service   tax<\/p>\n<p><span class=\"hidden_text\">WP(C)24483\/09         -: 2 :-<\/span><\/p>\n<p> thereon.\n<\/p>\n<\/p>\n<p>2.The aforesaid facts, by themselves, would show<\/p>\n<p> that Exts.P8 and P8A having been issued by the<\/p>\n<p> Municipality    refuting     the  claim  of    the<\/p>\n<p> petitioner, the matter can be resolved only on<\/p>\n<p> adjudication by the competent court, namely, the<\/p>\n<p> civil court. That view expressed by the learned<\/p>\n<p> Ombudsman for Local Self Government Institutions<\/p>\n<p> in Ext.P11 also does not, therefore, warrant<\/p>\n<p> interference.\n<\/p>\n<p> The writ petition fails and hence the same is<\/p>\n<p> dismissed    leaving  open    the  right  of   the<\/p>\n<p> petitioner to seek reliefs from the civil court.<\/p>\n<p>                       THOTTATHIL B.
