No.4477  of 2006\n\n                      -----------------------------------------\n\n                    Dated this  21st day of December, 2006.\n\n\n                                      ORDER\n<\/pre>\n<p>               Will     an   appeal   filed     against   the     conviction   and   sentence,<\/p>\n<p>which     includes   fine   also,     abate   on   death   of     appellant,   if   no   legal   heir<\/p>\n<p>obtains   leave   of  court     to   continue   appeal?     This  short  question     is   to   be<\/p>\n<p>answered in this revision.\n<\/p>\n<p>               2.  This  revision is filed  by  the son  of the deceased accused.\n<\/p>\n<p>The  accused   was   convicted   and   sentenced   by     learned   Assistant   Sessions<\/p>\n<p>Judge  for offence  under  section  354  of the  Indian  Penal  Code  to  undergo<\/p>\n<p>rigorous   imprisonment   for   a   period   of   2   years   and   to   pay   a   fine   of<\/p>\n<p>Rs.30,000\/-     and   in   default   of   payment   of   fine,   to   suffer     simple<\/p>\n<p>imprisonment   for   a   period   of   four   months.       It   was   also   ordered   that,   on<\/p>\n<p>payment   of   fine   by   the   accused,   Rs.25,000\/-     shall   be   paid   to   PW8,   the<\/p>\n<p>victim.\n<\/p>\n<p>         3.  The  deceased-accused was originally charge-sheeted  for offence<\/p>\n<p>under section   511 of 376 and 377 of Indian Penal Code on the allegation<\/p>\n<p>that  such offences were committed against PW8. After trial, on an  analysis<\/p>\n<p>of   the   evidence   adduced     in   the   case,   the   trial   court   found     the   accused<\/p>\n<p>guilty  of   offence  under  section   354   of   IPC   and   convicted     and   sentenced<\/p>\n<p>him under the said section.              An   appeal   was   filed   before   Sessions   Court<\/p>\n<p>against   the   conviction   and   sentence.   On   a   representation     made   that<\/p>\n<p><span class=\"hidden_text\">[Crl.R.P.4477\/06]                                 2<\/span><\/p>\n<p>appellant expired on 26.6.2005, as evidenced by the death certificate<\/p>\n<p>also,  learned  Additional Sessions  Judge held that the appeal abated.\n<\/p>\n<p>               4. Learned  counsel   appearing   for the  revision  petitioner,<\/p>\n<p>submitted   that   the   appeal   does   not   abate   in   this   case,   in   view   of<\/p>\n<p>section   394(2)   of   the   Code   of   Criminal   Procedure   (&#8216;the     Code&#8217;   for<\/p>\n<p>short).  It was strongly contended  that  the court is bound to dispose<\/p>\n<p>of appeal on merit and not dismiss the appeal as abated.   A reading of<\/p>\n<p>section 394 shows that every appeal    filed under section 377  or 378<\/p>\n<p>shall finally abate on the death of the accused, except an appeal from<\/p>\n<p>a sentence of fine.\n<\/p>\n<p>               5.   Learned   Public   Prosecutor,   however,   argued   that   by<\/p>\n<p>virtue   of   sub-section   (2)   of   section   394,   if     appellant   dies   during<\/p>\n<p>pendency of   appeal, if the near relative or relatives of the appellant<\/p>\n<p>do   not   apply   to     appellate   court   for   leave   to   continue   the   appeal<\/p>\n<p>within 30 days   of the death of the appellant, the appeal shall abate<\/p>\n<p>unless leave is granted by court to continue appeal.     The proviso to<\/p>\n<p>sub-section (2) of section 394     reveals that where an appeal is filed<\/p>\n<p>against conviction and sentence   of imprisonment   and the appellant<\/p>\n<p>dies during the pendency of the appeal any of his near relatives may,<\/p>\n<p>within   30  days  of   the   death   of the   appellant,   apply  to   the  appellate<\/p>\n<p>court  for   leave   to   continue   the   appeal;   and   if   leave     is   granted,   the<\/p>\n<p>appeal   shall   not   abate.   Therefore,     it   may   apparently   appear   that<\/p>\n<p>unless   application is filed by the near relatives and leave is granted<\/p>\n<p>as stipulated in the proviso, the appeal shall abate, it is argued.\n<\/p>\n<p>               6. To appreciate  the contention raised, it is necessary  to<\/p>\n<p>read section 394 of the Code. I shall  extract section 394 of the Code<\/p>\n<p>as hereunder:\n<\/p>\n<p><span class=\"hidden_text\">[Crl.R.P.4477\/06]                                3<\/span><\/p>\n<blockquote><p>                                &#8220;394.   Abatement   of   appeals.&#8211;\n<\/p><\/blockquote>\n<blockquote><p>                (1)   Every     appeal   under   section   377     or<\/p>\n<p>                section 378 shall finally abte on the death of<\/p>\n<p>                the accused.\n<\/p><\/blockquote>\n<pre>                                (2)     Every   other   appeal     under\n\n                this   Chapter   (except   an   appeal     from   a\n\n                sentence   of   fine)   shall   finally   bate     on     the\n\n                death of the appellant.\n\n\n                                Provided    that  where the  appeal\n\n                is   against   a   conviction   and   sentence     of\n\n<\/pre>\n<blockquote><p>                death or of imprisonment, and the appellant<\/p>\n<p>                dies during the pendency of the appeal,  any<\/p>\n<p>                of     his   near     relatives,   may,   within     thirty<\/p>\n<p>                days of the death of the appellant, apply   to<\/p>\n<p>                the Appellate Court for leave to continue the<\/p>\n<p>                appeal; and  if leave is    granted,   the appeal<\/p>\n<p>                shall not abate.&#8221;<\/p><\/blockquote>\n<p>               7.   A   close   reading   of   the   proviso   to   sub-section     (2)   of<\/p>\n<p>section 394 shows that the said provision applies only in cases where<\/p>\n<p>the sentence is   of imprisonment alone. It is only in   cases in which<\/p>\n<p>the sentence imposed is   of imprisonment alone that the appeal shall<\/p>\n<p>finally abate on the death of the appellant  in the absence of the near<\/p>\n<p>relatives of the appellant  availing of the benefit under the proviso to<\/p>\n<p>section 394(2).     However,   in cases where there is sentence of fine,<\/p>\n<p>appeal   shall   not   abate     on   death   of   appellant   whether     the   near<\/p>\n<p>relatives  apply for leave     to continue  appeal  or not. The proviso  to<\/p>\n<p>section   394(2)   applies     only   in   cases     where   there   is   sentence   of<\/p>\n<p>imprisonment alone.   If the   sentence is of fine or the sentence is of<\/p>\n<p>imprisonment     and   fine,     appeal   shall   not   abate     on   the     death   of<\/p>\n<p>appellant,  even if  the near relatives do not apply for leave under the<\/p>\n<p>proviso to section  394(2) of the Code.  Therefore,  the appellate court<\/p>\n<p><span class=\"hidden_text\">[Crl.R.P.4477\/06]                                4<\/span><\/p>\n<p>is bound to  dispose of on merit appeals filed against sentence of fine.\n<\/p>\n<p>Such appeals  shall  not abate   on death of appellant, irrespective    of<\/p>\n<p>whether     the legal heirs  apply for leave or not under the proviso to<\/p>\n<p>section 394(2).  The order passed by  lower appellate court    that the<\/p>\n<p>appeal abated on the death of  appellant is  therefore,  unsustainable,<\/p>\n<p>since sentence imposed in this case  includes fine also.\n<\/p>\n<p>               8.   I   gain     support   from   the   dictum   laid   down   in   the<\/p>\n<p>decision   reported   in    <a href=\"\/doc\/572782\/\">State   of   Andhra   Pradesh  v.  Narasimha<\/p>\n<p>Kumar<\/a> [2006 (3) KLT 505],  which was cited by learned counsel for<\/p>\n<p>petitioner.     The   relevant   portion   from   the   said   decision   can   be<\/p>\n<p>extracted herein:\n<\/p>\n<blockquote><p>                   &#8221;   It   t   is   true   that   an   appeal   from   a   composite<\/p>\n<p>                order   of   sentence   is   ordinarily   directed   against<\/p>\n<p>                both   the   substantive   imprisonment   and   the   fine.<\/p>\n<p>                But, such an appeal  does not for that reason  cease<\/p>\n<p>                to   be   an   appeal   from   a   sentence   of   fine.     It     is<\/p>\n<p>                something   more   not   less   than   an   appeal   from     a<\/p>\n<p>                sentence   of   fine   only   and   it   is   significant   that   the<\/p>\n<p>                parenthetical  clause  of  S.431  does  not  contain  the<\/p>\n<p>                word &#8220;only&#8221;. . . . . . . . . . . . . Whether or not   the<\/p>\n<p>                sentence   of   fine   is   combined   with   any   other<\/p>\n<p>                sentence can make no difference to the application<\/p>\n<p>                of that principle.&#8221;<\/p><\/blockquote>\n<p>        9.  On going through the dictum  laid down in the said decision,<\/p>\n<p>it   is   clear   that   only   in   cases   where   there   is   an   appeal   from<\/p>\n<p>imprisonment alone that the appeal will stand finally abated.  In cases<\/p>\n<p>where     fine   is   imposed,       appeal     will   not   abate   on   the   death   of<\/p>\n<p>appellant.\n<\/p>\n<p>           10. It was pointed out that  this revision  is filed by  son of the<\/p>\n<p>appellant and no application  is filed by him    for grant    of  leave   to<\/p>\n<p><span class=\"hidden_text\">[Crl.R.P.4477\/06]                                 5<\/span><\/p>\n<p>continue   the   proceedings.     Learned   counsel   appearing   for   revision<\/p>\n<p>petitioner,       submitted   that   this   court   can       exercise     power   under<\/p>\n<p>section 397 of the Code suo motu,   to   correct an illegality. Hence, I<\/p>\n<p>make   it   clear   that   I  have   exercised   only  the   suo   motu   power   under<\/p>\n<p>section   397   of   the   Code,   since   the   illegality   pointed   out   by<\/p>\n<p>appellant&#8217;s son   is a glaring one and   it deserves to be   corrected by<\/p>\n<p>exercising   revisional   powers.       However,   this   will   not   stand   in   the<\/p>\n<p>way of  revision petitioner approaching  lower appellate court  to seek<\/p>\n<p>appropriate order to continue the appeal, if so advised.  Whether such<\/p>\n<p>application   is   filed   or   not,   the   appeal   shall   be   disposed   of     by   the<\/p>\n<p>lower appellate court, only on merit.\n<\/p>\n<p>          In the result, the order under challenge is set aside.  The lower<\/p>\n<p>appellate court is directed to take the appeal on file and dispose of the<\/p>\n<p>same, in accordance with law.\n<\/p>\n<p>               This  revision is allowed.\n<\/p>\n<p>                                                                  Sd\/-\n<\/p>\n<p>                                                          K.
